Help! MBNA recorded 32 late payments!

Hi All,

I'm hoping someone can offer advice on my situation.

I opened a credit card with MBNA in January 2007. I used the card and paid all my bills faithfully.

I recently pulled my credit report from all 3 agencies, and was surprised to see that MBNA have recorded every payment between December 2010 and July 2013 as 1 month late.

MBNA are saying that I missed a payment in December 2010 and never brought the account up to date, which is why every month after that is 1 month behind with payment. They say because its a true representation of the account that they can't change it!

I'v looked at all my bank statements, and no direct debit was ever missed, so I can't see how I can have payed late and not brought the account up to date. It was all automatic via direct debit.

I am looking to go for a mortgage soon and need my credit history to be as top as possible.

Any advice would be much appreciated.

This is a bare-faced lie on their part. This type of thing is yet another example of how the relationship between lenders and the CRAs plumbs the depths of a dirty stinking cess pit.

The late payment fees would have been showing on your credit cards statements each month. If it's not displayed there each month, then there's an error.
  • Yeah, there's no way this went on for 2.5 years without serious alarm bells ringing - late payment fees, angry letters, calls etc.

IN FACT, if you pay by direct debit it's not possible, if you had missed a payment they would have taken double the amount plus the fee the next month, the worst you could have would be a single "1" recorded in 2010, they're talking out of their !!!!.

First response is always NO with credit companies anyway.

If you have your bank statements dating back to December 2010, then surely the easiest way to resolve this would be to write to MBNA and include a photocopy of your statement with any personal information blacked out, showing the funds taken from your account and also a copy of your MBNA statement dated January 2011 which would show that the funds from your DD had been applied / no payment was ever missed, and ask them to remove the incorrect data from all 3 credit reference agencies and see what they reply with.

I havent sent them any proof, but I have explained to them on the phone that i have checked all this and asked if they want copies, but they claim the records they submitted are accurate despite this, and that i don't need to send them proof.

Surely if the payments are on a direct debit, and every month has had the direct debit taken with no problems, then there can't possibly be any late payments?

If its on direct debit then they control the payments anyway right?

Thanks for all the help so far folks.

It takes time to set up a new DD. Most cc companies suggest you make a direct payment yourself for the first month, just to cover that.

It is possible that yours did not meet the deadline for the first payment due, so the first DD they drew was for the second month, thereby meaning you have always been a month behind.

The late payment notice should have appeared on each statement. If you do not hold the paper copies, you can check by downloading a recent statement online and looking to see if that shows a late payment.

That can't be the case, is the direct debit had been in place for over a year before they started recording the late payments.

The online banking for the card only allows me to download statements within the last 12 months unfortunately.

OP - can you confirm two things -

    1) that there are definitely no late payment fees appearing on your card statements?

    2) that it is definitely a DD you have set up, and not a Standing Order?
