Hi All,
Just updated my signature. Made real progress since I was last here.
I've just been made redundant and my confidence is in the toilet. I don't think I'm capable of doing my old job and I can't afford to pay my dmp if I take a job on lower money but with less stress. My last job was so stressful it was making me ill. I feel sick all the time thinking about it. All I have is time to think and I feel like I'm drowning.Original Debt in June 2014: £20,000

Some of our debts defaulted within 2 months and i would say Noddle would be correct so good news :-)
We are expecting the remainder of ours to default soon, well hoping....

I managed to negotiate our mobile contracts down in price. We are now at £5.00 each per month for our mobile phones. We were paying almost £15 per month each. Small savings, but it all helps.

They then waffle about the Act and enclose a reconstituted copy of the agreement. This debt dates back to 1997 so I thought the had to provide an original not reconstituted.
Please help and advise on where to go from here.

This is from Fermi's post on another thread :
If it is the original agreement, even if varied over time by them or re-issued/branded without you having to sign a new agreement after April 2007, then could be unenforceable.
- s127(3) Consumer Credit Act 1974 says that a court may not make an enforcement order on a pre April 2007 agreement (even if varied after) if an agreement containing the prescribed terms WAS not signed.
and
- s78(6) applies to all agreements, no matter the date, that a court cannot make an enforcement order on a debt while in default of a request under s78(1) for a copy agreement and statement of account. Unlike s127(3) this is a temporary unenforceability which can be remedied by reconstituting a agreement from other records, and does not require that any original was enforceable in it's own right under s127(3). i.e. even if they comply with a request, that does not mean it can't still be unenforceable under s127(3).

Quick question, I'm setting up the token payment plan with step change. Should I write to the creditors or just leave it to step change to contact them?

I would write and inform the creditors. Advise them you will keep them updated with progress and any change in your situation as soon as you have any update or changes to your situation. I would also state you do not give them permission to telephone you to discuss your account and that all communication should be done in writing. Assure them you will always respond promptly to any communication received.
By doing this you know they have been told of your situation and you won't be worrying about getting phone calls and with everything in writing you have record of what is agreed.DFW Nerd No. 1484 LBM 07/01/15 Debt was £95k :eek: Now debt free and happy :j0 -
I'm so sorry that a lot of posters are having extra problems in addition to the usual debt ones. Big hugs for anyone feeling particularly anxious about things at the moment.
I'd be very grateful if someone could give me the benefit of their experience again. Sorry to keep asking all these dumb questions:o.
I started my DMP in April 2013 with total debt of £56804:o. Have been paying £732 a month with SC and have now paid off about £25620. DMP will run until about October 2019 and I'm nearly at the halfway point:j. I must admit it's been a strain paying this amount but I just wanted to see the debt gone asap and I know I overcommitted to what I could afford. Totally my own fault as sadly I didn't come across all the brilliant people on this thread until some time into my DMP:(. It never occurred to me to build up a small EF by making token payments. I'd never heard of the idea and SC never suggested it to me:(:(
I know I could adjust my payments downwards at my budget review but I don't want to. I feel I can soldier on as before if I could just have one month of no payments at all(or token £10 to each of my 8 creditors). The few hundred pounds 'saved' would be a lifeline as so many appliances (cooker etc) are on last legs and the washing machine has totally died. My car is old but has plenty of life in it still so long as I keep it well maintained. All this needs money!!!!!!
Being able to save anything on the DMP is a nightmare. I'm trying to make a bit of extra by selling stuff, doing surveys etc but it just seems to go on eking out the budget, replacement of things that have worn out on the car, frequent big vet bills etc. It's certainly not for treats or anything other than 'needs'.
Do you think SC and creditors would accept this sudden cut in payments after so many months of no payment problems? What sort of back-up documentation would they want, such as bank statements etc? I'm not going to contact SC if it's something they usually don't do. Would I have to contact my creditors myself or would SC put the proposal to them?
Sorry for all the questions but I'm getting a bit depressed about how things are at the moment when I should be celebrating how far I've come.

Sorry about the redundancy, although sounds like it might have been a relief in one way. Have you considered making token payments for a month or two while you decide what to do, (even if you can afford it for the moment?) all you have to do is say to the creditors I've been made redundant and I can only pay £1 for now (stepchange like £5 per creditor). There are other ways to deal with your debt, DRO, IVa bankruptcy etc, maybe now is the time to consider those too, but don't keep it to yourself, contact CAB or SC for advice.
Redundancy may seem like a way of life these days, so many on here have been through it, but it's still earth shattering when it happens, no wonder your confidence is shaken. Don't know what your area of work is, but is there a chance you could retrain (forget the DMP for a moment), or move to a lower paid job that you'd prefer but has some prospects for the future. Being in a stressful job you hate is a recipe for a short and unhappy life and should be avoided if at all possible. What's the point of paying off debt if you can't enjoy life at least some of the time?
Don't give up but don't give in to panic either, take some time to think about what you want and need, but do it with help. Some employers provide helplines for employees affected by redundancy, if there is one, try it and see what happens?

Hi CBC, very well done on the debt busting front, but I think you are suffering from the 2 year DMP wobble syndrome. It's when life starts to get really tough, you've run out of all the overstocks that you could use up, there is still a long way to go the DFD and yet stuff is wearing out, needs replacing etc.
Yes been there got the t-shirt. I understand your reluctance to drop the payment extending your DFD, I did drop my payment, and seem to have lost the incentive to put it back up.
If you think you need a DMP free month, You could tell SC you have a big car repair bill/vets bill/washer repair/boiler bill. If it's true, no problem, if it's a slight variation on the truth, make sure you remember what you told them in case it really does happen and you are forced to drop a payment again. No one asked me for any paperwork for my reduced payments, but circumstances where a bit different. I think if it's a regular thing, they might ask, but I don't think you actually have to give anyone anything if you choose not to.
SC like to have a minimum of £5 per month per creditor, if you could find that for one month and miss the rest of the payment citing the reasons suggested or something better if you have it, I don't think any creditors or SC will bat much of an eyelid if you go back to paying again the month after.
