Sign it with a squiggle - just like the PPCs and debt collectors do!

What options does CP Plus give you for submitting your appeal? Follow those instructions, otherwise you run the risk of them either saying they didn't receive your appeal, or that you didn't follow their appeals process. They don't need any excuse to 'time you out' and refuse you a POPLA code.

If postal appeal is their requirement, then post first class via your Post Offuce with a free Certificate of Posting. Don't just bung it in a postbox, nor use 'Signed For' (previously Recorded Delivery).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Signed for is a waste of money. Companies often don't sign any way.

If you have free proof of posting that is evidence enough that you sent it.

because they can refuse to sign for it, hence not delivered

send it with free certificate of posting from the counter staff at the P.O.

this proves a letter was sent and the date and time, its deemed delivered 2 days later by law, same as their letter to you

bear in mind that time on site does not constitute parking, you paid for the parking time, and clearly any extra time was entering, finding somewhere to park, obtain the parking ticket , put it in the car , park , and leave

so yes you paid for parking, but they monitor time on site, the 2 are not the same thing , they should have allowed say 5 to 10 minutes grace too
  • Fair enough, thanks waamo.
  • Redx - ah, so actually they owe me money, given I paid for 60 mins parking but was only actually on site for 61 mins from entering car park to leaving?!

no , you paid for an hours worth of parking , same as if you pay for a pint of lager, if you dont use it all then its just wasted , so if you had left after half an hour then they dont owe a refund , but can still try it on with a speculative invoice

my point is that in the time alotted you could not have been parked for the full 60 minutes that was paid for in cash , parking companies dont monitor actual parking time, just on site time , they base their invoices on this "time on site" as it can generate more income, but the contract you entered into was to allow your car to be parked of 60 minutes maximum parking time , which it was, but you have to enter , park, get a ticket, and leave later, so they should have allowed for that entry and exit extra time , when the car was moving (so not parked)

  • Don't worry Redx it's late, I'm tired and I shouldn't attempt humour, just fed up with the whole thing and it's barely begun!

    lol

there is nothing humorous in this topic, when it comes down to extortionate demands for parking charge invoices, its a serious business , where they try to hold all the cards, so heads they win , tails you lose, even when you have paid

see the prankster link for the fistral beach court case

these parking scumpanies have tried it on with family and friends of mine, nobody was laughing, but the joke was on them as we have won or had it cancelled every time

plus I have cost them thousands of pounds by advising others free of charge on here too
  • I had heard a little about Fistral already.

All help very much appreciated and am hoping it all works for me, too. Thank you for your support
