CP Plus Ltd unexpected charge notice

Hi
I've just received a charge notice from CP Plus.
I'm not sure what to do as I did pay for my parking that day, however I didn't receive a receipt from the machine as it appeared to have run out of paper (or whatever).
I am disabled but, having read the notice by their ticket machine, decided to pay as it wasn't clear as to whether I was exempt.
What can I do to appeal, given that I have no physical proof?
Also, somewhat frustratingly, I paid by cash - so can't even prove payment using my bank statement.
Hope someone can help.
Thanks

Hi Dolphinwitchuk,
doesn't matter - having proof of payment rarely gets the parking company to cancel anyway - they don't care - they've had your money and now just want more.
But don't worry - there are legal arguments to use to appeal it
Place to start is by reading the sticky thread **NEWBIES!!
Have a read and come back with anything you want clarification on
tip - acronyms/abbreviations are explained in post #2 of that thread0 -
Hi, thank you for your reply.
I guess the fact that I am genuinely shocked that, even though I paid for my parking and didn't get a PCN they still want money, shows what a newbie I am!
Anyway, I have read the sticky thread and think that, as I am going away for a week today, shall leave the whole thing to sort out when I come back.
Having read the thread I feel completely calm about the whole thing now, as I can see that it is a totally fraudulant claim by CP Plus Ltd and the templates will be very helpful.
Thank you again.0 -

Can you confirm that this was a windscreen ticket, or has CP Plus written to you with details of the charge? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No, no windscreen ticket - I received a charge notice through the post yesterday stating that they did not have evidence that a sufficient parking charge was made to cover the full duration of the visit.
On discussing it last night with my husband, we reckon that the fact their timings are for 1hr 2mins (in and out photos) means that whilst I paid before exiting the car park at a walk up machine, I fell 2 mins over the hour and therefore they have decided I should have paid for an extra hour. Sigh.0 -
You need to appeal this. Just use the initial appeal from the NEWBIES FAQ sticky word-for-word. DO NOT try to embellish with your 'story', nor remove anything because you think it doesn't apply.
Get that off to them (simply copy and paste) and follow their instructions for making the appeal - whether that be via their website, or by post (if by post get a free certificate of posting from your Post Office, don't just bung the letter in the postbox).
If you're just away for a week and you've only just received their letter, action can wait until you're back - but it will be a priority once you are back.
Your initial appeal will inevitably be rejected, that's pretty much par for the course, but that will then provide access to POPLA where you can easily beat this.
If you have access to the Internet while away, have a quick read of the NEWBIES FAQ sticky as this will get this into some perspective and help you realise that this really isn't anything to be losing sleep over.
Have a nice break. Get back to us on your return. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi there
I'm just about to send the appeal using the standard template - will be interesting to see what happens.
Thanks for your help.0 -
CP Plus NTK are not compliant, so whatever you do, make sure the appeal does not disclose the driverDedicated to driving up standards in parking0

If so, put GPEOL last as it is currently on appeal to Supreme Court and isn't the silver bullet it once was.0 -
Shame I can't put anything in there about it being wrong to expect someone who has paid for their parking to be expected to pay for one extra minute of parking as the clock ticks over as they return to their car and leave the car park, isn't it?0

Thanks hoohoo - I'm doing the standard a-e (having moved a to e given the heads up from Guys Dad) along with Formal Challenge, Drop Hands and Breach paragraphs.
Otherwise just putting postal address and date at top and typing my name at bottom (am presuming accidentally forgetting to sign it won't be a problem?)0
