    Both parties turned up. The defendant argued on many points and he was entitled to park but the photos showed he did not have a permit displayed.

    more info needed, permit for where? type of car park? residential? retail? what?

    Sounds like a badly defended case, if its a residential site then theres a good chance that link parking are nothing but contractors acting for and on behalf of a management company, with the spaces being owned/let to the residents.

    This means that whatever happened in the 'lost' court case the resident has a good chance of getting the decision overturned on appeal.
    It may also be worth going for the management company and putting in a counter claim as it could possibly be said/argued that they have been negligent in allowing a company such as Link to operate.

    If the lease/rental agreements are in the clear my advice would be to tell the management/link to shove their permits where the sun doesn't shine, and park without a permit ( lease/rental trumps any made up rules, and if the land/space is owned by the resident then Link parking its management and staff can go swivel)

    If the Parking company continues to harrass and intimidate then refer them the Davey vs UKCPS, also make it clear that the management or whoever hired the Parasitic Parking Company (PPC) will be jointly liable for any costs.

    If Pauly447 is Martin perhaps he'd like to explain his view. After all, he is entitled to it.

    For those that are not aware, Link issued 162 claims in the first 3 months of 2015 so there will be a few default wins and the occasional CC win. If you think they don't/can't win at CC then you'd be surprised at how Judges react to these claims.
