County Court Claim Form

Hi,
Any advice on this would be very gratefully received and apologies if it's already been covered in another forum.
I have received what looks like a formal Court Claim Form (N1CPC form) and would be interested in some advice on what to do next. They are claiming £230 (£150 parking fine plus £5 interest plus £25 Court fee plus £50 Solicitors costs.
I would reluctantly pay something as I did park somewhere I shouldn't have but literrally for 5 minutes in the pouring rain and didn't notice any signs. But I don't want to pay £230 but neither do I want a CCJ against my name.
Any idea what I should do next please? i've ignored everything they have sent me up to now, which judging by what I have read on here wasn't necessarily a smart move :-0
Cheers,
Rob

who is "they" ? which PPC initiated it ? which court sent it ?
read post #5 of the NEWBIES sticky thread, that deals with real court claims, if it is one
have you checked it real by logging onto the MCOL website ? or is a manual one from Salford ?0 -
What parking company? Some of them have a habit of sending out fake court forms.Je suis Charlie.0

It's from Link Parking Limited and yes I checked the MCOL and it appears correct?0

You'd only pay the £230 if you lost, and only get a CCJ if you failed to pay.
You've also got a pretty good chance of paying nothing if you defend it correctly, assuming it's genuine.
First thing to do is contact the court that stamped the papers to check it's real.0 -

If it is an actual claim, (sent from the Court), then you will have also received other official court documents with it (response pack N9CPC, Form N9A, Form N9B and an Acknowledgement of Service Form)0 -
however , link parking do have one case in court today (Cardiff) http://www.bmpa.eu/court.html , so they are getting a bit brave0

Hi,
I've checked with moneyclaim and it's on there so assume it's legit? It also came with the forms you mentioned. Can't get through to anyone on phone as it's one of those automated systems, press 1 to be ignored etc :-)
Now about the defence, I've had a look at post 5 as advised above but am a bit baffled by it all.....
Not sure what my defence would be ?0 -
Acknowledge the claim, choose the option that says you are disputing the whole of the claim, and also the option for extra time to prepare your defence. Then start researching how to defend it (the Parking Prankster's guides to defending a ParkingEye claim are a good place to start).
Do you know who the landowner/occupier/managing agent is? If not, find out. Call them or write to them to tell them that you have received a court claim from their agent, Link Parking, and given that they (the landowner) are the principal you intend to apply to the court to have them, the landowner, joined to the claim as an additional claimant.
If you are on the 'phone, ask the person you are speaking to their name, and ask if they are the correct person to be nominated as the court's contact. Ask if they could provide a list of dates in the next six months when they will be personally unavailable to appear at court. Otherwise simply request the appropriate name and any date on which that person cannot make a court appearance. If they refuse to give a name simply tell them that their directors' names are in the public domain so you'll simply put one of them down (have a list of the directors' names to hand, read through it and ask which one they'd prefer!)
That ought to give them the willies and might get this thing cancelled straight off.Je suis Charlie.0 -
Thanks very much for that! I'm a little less baffled by all this now :-)0

You should see this thread on Pepipoo. It is a Link claim and quite detailed in the approach. Was stayed pending Beavis at the Supreme Court.
