why did who bother? my mate or the police? if it's the police I can not answer, maybe they were having a crack down on speeders, all I know is that he was taken to court and that he was only doing 35 in a 30,0

hello again all!
found 5ive.org very helpful if you have not been to magistrates court/speeding before, thank you. thank you again to all who have replied - both with website details and with their own stories.
this site is invaluable for anything really. i guess this subject could be considered mse as we are trying to reduce not only penalties and fines but also the effect that it may have on insurance premiums etc.
date is set for monday, so i will let you know how said family member gets on - fingers crossed all x0 -

In other words you want to commit crime time and again, but when you get caught you don't want the penalties you *should* have for that illegal activity.0 -

Oh, for heaven's sake! 10 million people in this country have 3 or more points (Honest John in today's DT). 10 million! That's one in four of the adult population, including non-drivers; probably nearly one in three drivers. Are you seriously suggesting that these 10 million people are all criminals? Speeding fines are an easy way to raise revenue, and that is why they are imposed for trivial lapses like 35 in a 30 (which was probably a 40 last week anyway).I used to think that good grammar is important, but now I know that good wine is importanter.0 -

I'm guessing he failed the attitude test and gave them a mouthful of "why aren't you out catching real criminals, don't you know I pay your salary etc etc"0 -
Poe Tuesday
I believe you will find the reason your friend went to Court was that he was either unable to produce or surrender his driving licence either at the time or within 7 days, or did not wish to surrender it at that time.
It may well be he was going away on holiday or business and needed to keep his licence for hire car etc, or simply lost it or couldnt find it.
In these circumstances he would have to be dealt with at Court, and if the court felt the reason for not surrendering it was reasonable, they would deal with it in the same way as a conditional offer and impose a £60 fine and 3 points as it would be difficult to argue the fact that the licence was needed for travel to another Country, they would need to deal with the offence at court as there is no licence to enter the points onto until his return and subsequent production.
The Police do not prosecute the offence or have say over who goes to court on a speeding offence which would ordinarily be dealt with by a conditional offer, and the magistrates would not go out of the sentencing guidelines to make an example of an individual who would normally be dealt with by conditional offer.
Conor, something else I learnt on the hardshoulder0 -
hi there
just a quick update for all those who have been really helpful.
family member got a 28 day ban plus £180 fine. can't really argue with that.
thanks again.0 -
I got a written warning from the police!
They suspected I was doing 95-100mph on open duel carriage way.
I spotted them before they caught up. Anyone doing around 120mph catching up stands out.
Average recorded speed over half a mile was 72mph
Very plesent experience walking away from the back door of the police car.Lets get this straight. Say my house is worth £100K, it drops £20K and I complain but I should not complain when I actually pay £200K via a mortgage:rolleyes:0 -

There is NOT an automatic ban at 100mph on a motorway, believe me I have worked the motorway for over 20 years, 100mph and win a bike is a myth.
Maybe you'll except the facts.

I'm sure Happychappy will accept your apology if you are gracious enough to make one.Jim.0
