even after looking at those websites, it's obvious that mrbadexamples reply (beer or no beer) sums things up quite nicely - and is the general concensus.
i don't undertand why people would want to go to court when its only a £60 fine?
the annoying thing is that only "Honest" motorists who can be traced get Fined, 2 out of 10 get away with it because the cant be traced, plus all the foreign drivers that the authorites cant be bothered to trace!:rotfl:0 -
I'm in court at the end of September for 36 in a 30. I've used Pepipoo extensively to prepare my defense. I would hope that if still found guilty it won't be too much more than I would have had if I'd paid up straight away, and I will then have the opportunity to appeal.
Pepipoo has been invaluable, not everyone flashed for speeding is 'really' speeding, there is a lot of sharp practice with the cameras.
Your relative could take a look at Pepipoo, it will help him prepare for court.There is nothing either good or bad but thinking makes it so.0 -

my mate got banned last week, he was going 35 in a 30 and his points added upto 9, he got a 6 month ban, he had a solicitor with him, he lives 70 miles from where he works, he did a specialist job, he does regular volenteer work and looked after his mother (all of which he needed his car for), even with all these reasons for needed his car, he still got a ban ;-(
so there is no telling, you can have all the reasons in the world as to why you should not get banned but if the magistrate is in a bad mood etc then you don't have a hope0 -
You need 12 points for a ban though. Plus 35 in a 30 is 3 points.
Do you mean he had 9 points and then another 3 for the 35 in a 30?
I had 9 points for 18 months and was very careful. (I'm on 0 now).
A friend of mine had the opposite experience. He was at 3 points and was caught doing 87(I think)in a 50. He went to court and said that the magistrate and officials were very sympathetic and he ended up with 6 more points and a fine for a few hundred.Happy chappy0 -
HELP HELP HELP!!! Our car was flashed by a camera doing 36 in a 30. The morning it happened my husband and I both drove up and down the road several times, (the camera is at the top of the road where we live).
I replied and said that it could have been either me or my husband, that even from the photographic evidence I couldn't confirm which of us. I said I would take responsibility as the registered keeper, but that I couldn't say for definite that it was me.
Now they have written and said I will receive a summons to court because I have failed to disclose the driver of the vehicle! Apparently this is nothing to do with the driving offence.
What should I do? Should I get a solicitor or something? Not sure I can afford that.
If anyone knows of a similar situation, please advise what happenned.0 -

There were two guys in a simialr position when I was in Court (this was about 10 years ago though)
Both denied being the driver, both in the dock together.
No-one, and I mean NO_ONE believed their story but they stuck to their guns almost with a smirk on their faces and stated over and over again, they couldn't recall which of them was driving.
They got off with it, completely discharged.
I heard they had modified the law in these cases, the additional charge of not disclosing the driver will stick now. This almost replaces the speeding offence which can't be proved.
The law is covering it's !!!, it will have you one way or another.
Not saying you should perger yourself, but they will have you one way or another!
Claiming you can't recall who was driving reeks of dishonesty! Do the crime, take the punishment, just plead for leniency.0 -
CHR15, I take your point, but my husband and I both drove up and down the said road several times that morning, so we genuinely can't say for certain who was flashed. I'm not trying to shirk the responsibility. BUt it is actually possible that the police could have more pictures, apparently they often don't send you all the pics. If they produce photos that prove I lied about the driver then I could face prison.0

Go for it, like I said, don't perjure yourself.
I watched two guys walk away scott free by digging their heels in even though it was obvious they knew.
They have clamped down though so expect a tough ride, good luck to you both:)
