I vaguely remember a case from my limited studies of law at university (part of an Engineering Degree, I wasn't actually studying law). It was along the lines of someone paying for the use of a deck chair. They paid for the services and the T&Cs were listed at the place where the contract was made (a hut or something). But there were extra T&Cs on the back of the ticket given out when the chair was paid for. Such T&Cs were unenforceable, as they were after the fact, or something.
But this was over 10 years ago, it could have simply been an example used by the lecturer. Or indeed, a dream I had after a heavy night in the student bar.0 -

whatever the item code should have belonged with it had to be iomega as if you enter individual part numbers before and after the quoted one.. they all relate to iomega0

I'm more than happy for anyone to challenge anything I post, and if they have a vaild point I'll say "fair do's". In fact, your point about the "order confirmation" DOES look to be valid, but it wasn't clear from your post whether you were making a sweeping assumption or whether your comments reflected something contained in their T&Cs (something which Sponge has clarified by quoting directly from the T&Cs).

i'm afraid this opens a whole can of worms over internet shopping....a large company decides to get rid of all those hard drives that a manufacturer sold them and wanted to get rid of them quick....they come up with a figure just above cost and put them on the website ....they are inundated with customers so decide to withdraw them and re-sell them in the future at a higher price...all they need is a set of t&c's that they can use as and when they liked.
if everytime you purchased something the company had to abide by your own personal t&c's that you emailed them ....the economy would grind to a halt.
eg hammy the hammer states "if goods aren't delivered within a week these goods are liable to be returned at no charge to hammy as one assumes that an error must have taken place in the process"0 -
I've just had an email from DELL stating that they've had to cancel the order as it was a misprice.
Fair enough. Tried and failed. It's not worth going to the law over £23.The atmosphere is currently filled with hypocrisy so thick that it could be sliced, wrapped, and sold in supermarkets for a decent price and labeled, 'Wholegrain Left-Wing, Middle-Class, Politically-Correct Organic Hypocrisy'.0 -
