Make sure you have replied to the e-mail that Amazon sent you.

A-Z is generally auto-decided in favour of the buyer - if you reply to the original e-mail statinng that you have requested the buyer to return the item, this means a human will look at it.

Copy into your e-mail reply all the responses you have entered into the Case.

Amazon does tend to refund buyers as the default course of action, but if you respond directly to the A-Z notification usually this will get a human being to read with a bit of sense...

I have now spoken to seller support who advise me to send an email to the A-Z team advising I have requested the return of the item and will pay postage on receipt will refund. They will then send the buyer an email themselves advising him of this. I explained he ignores all my emails.

What I find odd is Amazon have the power to debit my account without item being returned even though I have done everything in my power to resolve the issues.

OK I initially made the error but that does not give anyone the right to keep a fairly high priced item and get a refund as well.

I did what you suggested and have had a reply from A-Z team thanking me for information and will respond in 7 day.

It's what you sign up to with Amazon. They aren't even wishy-washy about it, everyone is treated the same, even if you buy from Amazon they'll refund straightaway if there's a problem.

So based on that the system is open to abuse. We shall see what happens but based on all comments its going to be difficult to get the item back but not impossible

No doubt the buyer is feeling very smug with himself knowing he will get refunded and still has the item. However once a decision is known I will not let the matter rest and will resort to legal action to recover the item.

Its my own fault and I should have checked more thoroughly before listing item but a hard lesson has now been learnt.

Possibly, but not as much as with Ebay, the way Amazon works it's less likely to happen and if it does, it can't really happen more than once.
At this stage you don't know that the buyer is doing anything wrong (unless I've missed something in your posts).

I see what you mean but obviously the buyer is not interested in resolving the issues with me and just gives me the silent treatment.

However I have made this known to Amazon I am trying to get the guy to return item and i pay postage. Also I reply to Amazon via my email account and I know now someone is reading the message.

If may be the case if he just keeps quiet then after 7 days Amazon do an automatic refund despite of my best efforts.

Great, what should happen now is that the buyer will win the Case, but he will be asked to return it for a refund and they won't be refunded until they do.

Not without getting the item back first.

As I have made this clear to Amazon I am willing to pay for the return postage would they make this known to the buyer. Also If Amazon
rule in his favour and refund without item being returned and he still refuses to send back is there anything I can do legally to reclaim it from him. Thanks,

You can take either Amazon or the buyer to court to reclaim the costs of the goods they have confiscated from you.
