Eviction proceedings due to Merlin loss adjusters non payment to contractor

    yes Marktheshark a County Court issued letter , the remarkable thing is both Merlin and legal and general delt with every issue , every step of the way, my wife and i would never have known were to begin, so we followed advice from these companies just implementing our insurance claim every step of the way, how worrying is that for us all

    Hi Marktheshark you mentioned Well you now call your local county court and demand a copy of the order

    we have done this and are awaiting a copy,thankyou all for your advice,its been very helpfull, were playing a bit of a waiting game, as none of the individuals involved wish to return any calls were leaving on their answer phones etc, bit stuck for what to do next,its complete madness

    You are more likely to receive helpful advice if your problem doesn't have to be disinterred and 're-worded' by the reader.

    I would suggest an e-mail to [EMAIL="customerservice.gi@landg.com"]customerservice.gi@landg.com[/EMAIL].

    It should be headed "FORMAL COMPLAINT - [Policy Number] and have a copy of the document attached to it.

    The content should say "We are extremely worried and distressed to find the attached notice seeking possession of our home as a result of non-payment of costs incurred in dealing with a claim following a fire at our home in 2009.

    The costs were authorised by your agent, Merlin and it is quite clear that they failed ensure that the costs were met and you failed to ensure they discharged the duties you delegated to them properly.

    As a result of your incompetence, we now face the imminent loss of our home.

    We demand that you IMMEDIATELY act to ensure that the debt is settled and our home safeguarded from the consequences of your incompetence.

    We also demand compensation for the trouble and upset we have been caused as a result of your incompetence."

    Note that if you get it received at Legal & General by 5.00 p.m. it will count as having arrived today. Note too that "FORMAL COMPLAINT" takes it out of the hands of the monkeys and given to an organ grinder.

    Check your insurance policies and any trade/union memberships to see if they have any legal advice/legal expenses coverage.

    thank you all for the advice, its very much appreciated

    may i apologies for my sentences or wording i'm not collage tutored or a university student in any shape or form, thank you for any responses.

    As soon as we have any information we will post them onto here as a progress up date to hopefully be advised,

    ampersand we did as you advised called the local CAB, as advised we are in the process of writing to the court etc

    magpiecottage we are following your advice too and drafting another letter, will keep you up date regards to any response

    Stator thanks for the advice, not sure what the troll term is for, but i will add, (stupidly) that we had house insurance only no contents cover or legal cover.

    But around 3 years ago after the fire we up graded our policy (great eh), we added legal cover, but its no good for this new scenario as is classed as an old claim, even though conveniently they say they have no file.

    thanks again for your help, my wife and i went to bed yesterday around 8.30 in the evening obviously we got no sleep, as we probably won't tonight,

    you guys probably don't realize what a help you have been, we first posted in around 2009 regards to the fire incident, 2015 were back regarding the same companies, who could not care less, thank you for the interest.

    If you were not notified of the court hearing you can file a N244 form over the counter at the court on Monday morning which will stay the CCJ immediately until it is investigated with a hearing.
    Put non service of court papers to defendant correctly as reason.
    There is a fee to pay but it will put a hold on things until you can get some legal advice.
    I do Contracts, all day every day.

    The fact that you did not have legal cover at the time of the fire should not be relevant, you have that cover now and the legal issue is nothing to do with the original claim, it's a totally new claim.

    well just an up date regards to our dilemma,

    keep pedalling legal and general have still not got back to us , as they said they would, and it still stands as far as they are concerned no legal cover

    we have followed all recommendations from you guys, and we have not had a single response from either groups.

    we did hand the n244 form into our local court and we have a hearing booked for this coming tuesday, to see if the eviction order stands, great eh ???
