    Thanks, this is a great idea! What happens with Vodafone though? Isnt it that they own the phone until I've paid off my contract? What would happen if they demand I return the 5s and its been sold?

    It's not a problem to sell it so long as you pay off the contract, if you don't pay it off they will possibly block the phone and the purchaser will get a bit upset.

    So I should hold onto the phone then? The value of the phone wont cover the cost of the contract and I don't want to be in a position where I have another person/company chasing me for their money :(

    Unless it puts you in a position to pay off the contract, then no there's no point to the exercise

    I don't recall a single report about a phone blocked as a result of defaulting on a normal phone contract, but if you can't pay the cost of contract and are likely to default, I don't see any point in selling the phone anyway.
    Try getting it unlocked by Vodafone while your contract isn't terminated yet .

    Voadfone refuse to unlock the phone whist there is an outstanding balance on the account.

    I've just come off the phone with Vodafone again - they have confirmed that my only action is to default and deal with the late fees that come with it.

    I find this totally disgusting - they will be making money from the fact I'm forced to default! This explains the reasoning behind their policy perfectly.

    The money they make" will be to cover the loss of cash-flow and the costs of administration and debt collection. Unles, of course, they are prepared to work for nothing. Are you?

    Nobody forced you. You've got a contract and a phone that you couldn't afford in the first place.
    This explains the reasoning behind their policy perfectly.
    To be fair to them, most financial institutions behave the same way. You have to default first if you want a payment plan and/or interest frozen.
