Not sure what I should do

Yeah, well I'll try and briefly sum it up!

I won a phone on ebay on the 6th of July. Later returned it as it was faulty (everything worked perfectly... except it couldn't actually make phone calls!). So he said he'd exhange it straight away.

Some time later I received the new phone, prolly around the 25th, but then after a few days I found out that this phone had a fault. It couldn't stay on for more than 10hrs max.

After reading a few things online, it turns out the batteries are fake. So.. I used a friends battery (same model battery) and that seems to work better than the fakes but still can't last more than 18hrs.

Anyhoo, the 45 day protection thingy is nearly up soon, so I was wondering what should I do? I don't want him to say that he'll send another one out but then just wait the 8 days or so out. Should I open some kind of dispute? I'll definetely be messaging him first, but what should I say?!

I really did not do a good job of briefly summing it up.

    If it's just a battery problem, can you not just email the seller to explain and ask if he could maybe send you a new battery?

  • I'm not exactly sure what the problem is.

    The phone wouldn't last more than 10hrs with the original batteries, then they won't last 18hrs with the new batteries. So I don't think it's the phone itself. The phone charger itself is actually bent.

    To be honest, I know that there is something wrong with his products as the batteries are fake, the charger is bent and the headphones are definetely second hand.

    I just didn't mind at all because as long as it worked then I'm happy. But I'm just unsure of what to do as the 45 day thing is running out.

    You could just mail then and tell the seller you aren't happy (after explaining the problems of course) ~ see if they will offer a refund :)

    It was classed as brand new on the listing, and to be fair it does seem new unlike the charger, batteries etc.
  • id just say it is not brand new and the stuff it come with doesnt work they should say theyll replace it if not definately start a dispute with them and put down it is not brand new or whatever as stated!!!

    I suppose if it was cheap and the one you wanted, just buy a new genuine battery for it.

  • I used my friends genuine battery which was the same model. Won't last any longer than 18hrs.

    Perhaps they're all like that?

    I've got an N95 and it only seems to last 8 hours at most.
