EA Underhand tactics...

How common is it for EA's to use underhand tactics nowadays?
Thankfully our EA who we are selling with have been nothing but upfront and helpful.
The EA selling the property we are interested in are anything but.
Constant lies which have come undone. Patronising me through email when I accidentally put my property number with the one they are selling and I quote
"It's 7 ***** not 2 *****, just to clear that up"
Now, the best bit is our buyers pulled out and now our seller wants to put their house back on the market. Which is fair enough as he has a deadline. Now you would think the EA would of contacted us and just be straight with us.
No, we saw the property was pulled on right move and was no longer for sale. We had to wait until Monday to get hold of the EA to find what was going on.
When we did ask, we were told that the property was still available, but it had been put on private eye mode on right move so only us and the EA could see it. Private eye mode!?
Well today we finally get told what I had been expecting, the property is going back on the market. Why they couldn't have just said that, I don't know.
But the worst bit was they contacted our estate agents for information before they put it back on. Needless to say, our EA wasn't impressed and said it was the first timothy have ever had this happen.
It just reeks of desperation. Our offer still stands at the minute, but my main concern now is what happens if we do proceed again but actually get the the valuation and survey done. I'm worried that we could fork out and they pull out or sell to someone else. And I get the impression this is all the EA's doing and not the vendor.
Could I ask for the house to be STC in writing and signed before we arrange a survey and valuation.
Any other advice just short of pulling away completely?

Yes you can ask for the house to be Sold STC before you arrange the valuation survey, but they might say no. You might ask them to confirm that no more viewings will take place. You can also ask them if anyone has seen the house recently and who they think might put in an offer. They can clear up some of these details for you but unfortunately you have to take them at their word and then go ahead with the survey. If they play hard ball and demand you do the survey before they take it off the market you only have two choices: A) Do as they ask or

Whatever anybody says, writes down, or puts on RightMove, only one thing is relevant - until contracts are exchanged, either the buyer or the vendor can pull out at any time, for any reason.
If you don't like the EA you're selling through, then look at your contract to find out when you can remove your business from them and take it to another agent.0 -

Quite sure your estate agents are the same , should you be buying from them not selling

I saw it how I see your post.
Unnecessary criticism that has no bearing on the situation. I really don't get the need to jump onto a thread and go out on the attack. It's not just me, happens all the time. People looking for genuine help only to be shot down.
So, Without knowing me or my situation you have managed to deduct that the EA is not the issue, but I am.

YOUR buyers pulled out....you knew the chain was on hold.....so it is most likely to have been your own solicitor that told your sellers solicitor that you could no longer proceed as the chain was broken. I dont think the estate agent was responsible for letting you know or being straight with you. They are working for the sellers and have to do what they tell them.
You do feel a bit frustrated but the agent has done nothing wrong, I think you are expecting a bit much!0 -
