CEL contract with the Co-op was terminated early on 19th December 2014 (I think)

My assumption is because of the huge number of complaints that co-op received regarding CEL's car park 'management'.

During a management meeting at the Co-op's HQ, one bright spark with an eye to his future said:

'Hey guys, I think CEL are losing us customers, I wonder if that's why our profits are down? I think we should kick them out'.

'Good idea', said the others, 'That will solve the problem, no more car parking issues, no more complaints, our customers will be back and profits will grow'.

'Now, let's look at a better way of really looking after our customers' parking needs'.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • So the consumer foots the bill because these toerags seem to think its ok to just take every and anybody to court and literally ruin ones credit status. Because they lost a contract.... due to the fact they were being unfair in the first place. This is so unfair

agreed, welcome to the "real world" , where people like myself and others have been fighting these people for 2 to 3 years (or more), plus

    1) complained to their MP`s,
    2) complained to the BPA and the DVLA,
    3) helped to crowdfund Barry Beavis in his fight against Parking Eye,
    4) plus participated in the recent government survey that Eric Pickles started as Communities Secretary before the last election, which finished about 3 weeks ago

plus any other actions whereby we can try to instigate change and fairness

so have a read of parking pranksters blog site
    plus the pepipoo website
    and the legal beagles website
    and the parking cowboys website
plus the Tracy Kiss expose on her fight against these p@rasites

plus several more sites fighting back
  • Don't worry about your credit status, the only way that can be affected is if you lose at court and then don't pay. Its a long way from that happening.

You've done the right thing finding here and pepipoo, and I'm certain the advice you receive will result in a favourable outcome. You may even manage to get some money out of CEL for your genuine costs.
  • Defence all sealed and ready to post tomorrow thanks to Bargepole.

    What happens next?
Do I need to ask CEL for any letters they sent me?
I contacted Co-op and there's no hope of them contacting CEL to get it cancelled.

You are now dealing with the Court, so you don't contact CEL at all.

Wait now until you get the Directions Questionnaire, so that the case gets transferred to your local court.

Then we'll see if CEL are really going to go ahead with this. I would also suggest there's no need to post updates to this thread until much further down the line.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    Will bear that I mind.

    Hi

Just a quick note to say thankyou for all help on this forum and to give you guys a quick account of what happened to me in case it helps any one. I had my court date last Friday against DEAL (originally civil enforcement ) after overstaying in a coop cat park in 2014. I never ignored the letters but followed the advice on here to the letter , so I originally asked for a POPLA code which was never given, then the usual letter from the solicitor Shwarts or something costs going up up £215, then court papers which tbh I didn't expect would happen and was really worried and kind of wished I'd paid the original fine?! As the costs they said had would go up to £545?! I sent off the defence copied from this forum.
I read on here that they hardly show up but I thought knowing my luck they probably will.
It was at worcester court and i went and waited 40 min to be called and they didn't show up! Lucky for me as I really believe the judge was kind of on their side as he asked me if I had heard anything of why they haven't come and I said I have read that they never show up and he was like no they do normally?! And when I said about their fake solicitor he was showing me something saying no that's actually a red herring going around and he is actually a fully qualified solicitor he just had his membership no not correctly down or something?! Anyway it was thrown out, I asked for expenses and just got my diesal, postage and parking that came to roughly £16, he wouldn't let me have waste of time as I didn't take time off work, I said I could have done private work today but he said no.
I hope this helps, just to say that I'm glad I didn't have to pay but if I knew IT would come to this I would have paid the original £45?! As I wasted a whole day and time but at they didn't get a penny after all their bullying tactics!
    Thankyou all again.x

Perhaps you should now send CEL/DEAL an invoice for your wasted time? (A PCN of your own - a Personal Costs Notification). And if they refuse to pay it then issue a small claim against them? :)

There may be a way you can complain against this waste of everyone's time, read this
