    Excuse the late reply. Had some technical matters to sort out. I will be returning the acknowledgement tomorrow. I am so scared that the judge will find in CEL's favor.
    What's wrong with sending it today.
  • By my reckoning you received the papers on 1/6/14.

    You are in danger of not acknowledging service within 14 days.

    If that happens CEL will win by default.

    Do not wait until tomorrow - get the Acknowledgement of service done today ! - on line using Money Claims on Line (MCOL)

    It's fairly easy to do - tick I intend to defend the claim in full

    The date of service is stamped as 05 JUN 2015. Isn't it 14 days from this date?

    CEL claims are not done using MCOL, so you can't do the AOS online.


    They use the manual forms via Salford, so the forms need to be posted back there.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Yes that's the address.


    If the date of service was 5 June, you have 14 days, plus they allow an additional 5 days for postage, so it must reach them by 24 June at the very latest.


    A lot of the advice on here is well intentioned, but is posted by people who have never seen a court claim form, or the inside of a courtroom. I've been there, done that, and have a wardrobe full of T-shirts.

    Last Monday I received a County Court Claim Form. The claimant is Civil Enforcement Limited and their client The Co-Operative.

    @mumwantsjustice - Apologies - was reckoning back from the date of your first post on 8th June when you said forms were received the previous Monday (i.e. 1/6/15)

    @Bargepole - thanks, my bad - mistook the following
    I will be sending the Acknowledgement of service back to the County Court Money claims centre tomorrow morning. I intend to defend all of the claim.

    I have no intention of getting into a spat with you as that wouldn't be helpful to the OP but if that remark was directed at me - then I would just like to point out - you have no idea what experience of court claims or court rooms I have or don't have and your assumption that it's none is wrong.

    The car park is a free car park and as such there can be no loss suffered by either the claimant or the landowner as a result of any alleged overstay. The charge of £££ (plus other fees) is therefore not a genuine pre estimate of loss. ?? what is the £££ is it the total amount claimed?

    It's the original parking charge, probably £100.


    i wouldn't worry too much, yours may be one of the very rare cases where CEL actually do turn up to court, but it's long odds against.

    I suppose given my luck my case would be the one CEL turns up for.
