What matters is whether somebody has filled up with dishonest intent. To do so and realise that you've not got your wallet isn't and is 'a civil matter' sir.
To fill up knowing you haven't got your wallet is more a matter of assuming the rights of the owner and could be classed as theft, but is more likely to remain a civil matter.
You just try and prove to a court that someone filled up knowing they had no means to pay, an impossible task if there ever was one.0 -
I don't like having to be dependent on the goodwill of others. What if you're miles away and it takes someone an hour or more to get to you? I've been keeping a bit of cash in the car for over 20 years, not about to change that now; plus cash *always* work, everywhere, unlike card processing systems

Even if you have the intent to remove the car from the premises where is the intent to permanently deprive the garage and where is the intent to steal?
I take it yiu are either guessing or making naive comments rather then trying to provoke a reaction.
You intend to permanently deprive the garage of the petrol when you put it in your tank. The issue is one of dishonesty. If you've genuinely forgotten your card/money or indeed if you actually pay for the petrol, then you are not dishonest and it isn't theft.What will your verse be?

I filled up at Sainsbury then realised I'd got no money, no cards and no ID. Cashier filled on a form for me to sign which gave me 7 days to go back and pay. As the cashier pointed out, unless I'd nicked the car, the police could track me down through the number plate if required. No fingerprints, no big deal.All shall be well, and all shall be well, and all manner of things shall be well.

Keep some money in the car, if you are few miles out,and offer to pay back, you then have to drive there and back wasting fuel.0
