Quite a confusing thread this, read from start to finish. I don't think matters are made clear by not answering questions directly.
Just to clear up something for those that may be desperate to know:
Homefile is a level 2 survey equivalent to a Homebuyers survey today. It would be purchased by the OP just like a Homebuyers survey, for the benefit of the OP. It should have recommendations on the final page with a summary. I have one, from Ekins, and it's longer than 4 pages long. It comes in a plastic binder/file with bound edges and tabbed pages. Either it was forged or it was incomplete, the latter being more obvious with pages missing.
I'm pretty sure this case is quite simple. If there's evidence to suggest that part of a survey was withheld by the surveyor accidentally or otherwise, then the surveyor's PI insurance will pay out. If the lender received the report from Ekins intact but failed to pass it on intact, then there's a case against the lender. Since the OP is suing the lender, the onus is on the OP to produce the evidence that information was withheld. Key to all of this of course is the evidence that the survey existed in a different form. I'd be keen to hear the lenders side of the story.
