    I purchased a property and I paid for a homebuyers report to be carried out!! I read and re read and took the necessary action suggested (electric Inspection paid and conduction). . I thought the lender was only interested in the Valuation (hence the reason for 4 pages). If there were no cracks at the time this was conducted I imagine that the property would then be valued at the amount the OP requested to mortgage. Hence the mortgage was then offered.

    This being said, why is Barclays at fault for granting the mortgage requested by OP? OP if you had instructed a full survey in 2000, as there were no signs of subsidence (as you said they appeared in 2006) would you then hold yourself responsible??

    Totally appreciate the fustration of having to repay the mortgage, (this happened to a lot of home owners when market was in a state and they were negative equity). I appreciate it wasn't to this extent, but why is this the fault of the bank? Can you be covered by your Insurance??

    Why would the client ask for a faxed copy of a valuation to then not read it - every client I know wants to see the survey, whether a basic val or full on survey.

    Why would you want to complete on a property that says something negative and not query it? Most people try to renegotiate it if there is a negative comment.

    Im not legal eagle and have no idea who owes what to who and where it will end but I can definitely see why as a layman (s)he would be miffed. I know when I bought my first house before I was an advisor I got the basic valuation and did not have a clue it basically meant nothing - although I was about 22 at the time.

    Bottom line OP did not pay for a survey to be conducted. Had this been the case, OP would then need to sign terms of business with Surveyors and survey sent directly to OP (not Barclays) Valuation is sent to the lender.

    This thread screams- HOW DARE THEY LEND ME MONEY TO BUY A PROPERTY I WANTED, yet didn't bother to take the necessary precautions.

    Sorry to sound harsh, but this is a very expensive lesson learnt!

    I wish you good luck trying to prove that the lenders only provided you with 3/4 pages from a survey. Missing the most important section which would result in most buyers not continuing with the purchase.

    Sorry who said I did not pay for the survey I did you seem very keen to make decisions without all the facts.
    The lender did not disclose the full facts in the survey and this has been stated in court and Barclays have not challenge this matter.

    They are in the wrong and have lied all along as can be proven from their written documents.

    Again.

    When you found the issue and informed your buildings insurance, what did they say?

    Have you claimed through them?

    Did they reject or accept your claim?
    If the former, for what reason?

    The insurance company that covered me in 2000 refused to consider it as it was 12 years since I had insurance and the last company I was with when I discovered the problems said my issue was with the lender and refunded my payment.

    You were asked on numerous times earlier in the thread if you had paid/requested a survey. You have yet to state what type of survey was conducted (Homebuyers/ Structural). Which lead to my interpretation that you paid for a basic valuation and survey. :D

    You also state that you received a copy of the survey 4 years later!!! Why wouldn't you check this in 2000 before committing to the purchase?

    Of course it was checked in 2000 by me and my solicitor ,3 pages received.
