    I would be tempted to contact the council legal department. Demand they explain why they have allowed their agent, who is not a solicitor, to issue a claim for trespass. Tell them you are minded to report them to the Solicitor Regation Authority for employing a none solicitor to carry out a reserved activity.

    I'm betting they haven't authorised Trev to conduct litigation (they can't) and won't want an investigation by the SRA.

    those two were or are confused and deluded , they either accepted or they were blind to the fact that the CSA is not a RECOGNISED APPROVED trate assoc for parking

    We need to be sure first that the claim was for trespass and not good ol' fashioned parking charge. ANPR have only started using the trespass angle since April and their being booted out of the BPA. This case predates that.

    no they have been using trespass for quite some time via v888/2 , check dates on this and pepipoo forum


    second letter clearly says trespass on the small print lower down

    b: acting with it , but without the courts authority , he is not a qualified lawyer.




    either drop charge , pay all costs , or accept the wrath of the solicitor's regulatory lot




    they are going to have to answer that question , and act either way.

    But he hasn't brought a claim on behalf of the landowner, he's brought it for himself. That might be stupid, since he has no locus standi, but it's not illegal.

    There's an awful lot of red herrings swimming about on this thread. Whilst everyone is getting their knickers in a twist over Preston Council the OP still has a CCJ against him, and getting rid of that (which does not involve Preston Council) is his priority.

    He doesn't need to sue anyone for the £155 set-aside application fee, if the application succeeds and he subsequently wins the case Trev will have to pay it back to him anyway.
