The crucial "detail" is that this is one of Trev's stupid trespass claims. Since he isn't the landowner he hasn't a hope of making it stick and probably will not even show up if you succeed in getting it set aside.

If Trev is claiming for trespass he could be in a spot of bother. He isn't the landowner or have any interest in the land. In other words he is the landowners agent. He would have to bring action in the name of the injured party.

To bring court action on behalf of someone else you have to be a lawyer. It's a legal requirement and a criminal offence to act in a privalaged manner if you aren't entitled to do so. It will be really interesting to see the particulars of claim.

and I get the idea that Preston CC , after reading MSE and Pepipoo , will deny his authority to press charges , they are now wondering about there liabilities as his employer

they have been informed that he is not in a APPROVED ta , but yet they think (or have been conned) into believing the CSA is an APPROVED ta with regard to parking and trespass,

they were warned on the 15th of may that this was the case (see pranky 21st may) but decided to go

    lala.gif

having seen the above papers (yes they have!) , they are now VERY VERY worried of an more court claims after 1st april ,

T Whitehouse only method of DVLA access is

    1: CSA , illegal

2: v888/2 ,, not applicable or acceptable for a parking Co , must use recognised ATA

due to lala.gif attitude , I hope it hurts them when people counter claim and inc them in there claims

I am getting close , very close to him loosing 8 car parks in Preston , with the paper trail , I only hope that other members tell the other car park owners

    1: CSA , illegal

2: v888/2 ,, not applicable or acceptable for a parking Co , must use recognised ATA

3: Use a stooge to submit V888 requests as a private individual

V888 is for a private individual to request name and address of the registered keeper at a specific date https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/417442/V888_200315.pdf
V888/2 is for a company to request name and address of the registered keeper at a specific date https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/390562/V888X2_241114.pdf
V888/3 is for a company which issues parking charge notices to request name and address of the registered keeper at a specific date
    https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/414973/V888X3_050315.pdf

In the case of a V888/3 it states on the form:-
If you are a car parking or wheelclamping company you must be a member of an Accredited Trade Association (ATA) to request information from DVLA either electronically or by post, otherwise we will reject your request for information

how about getting PCC to pay the charge , threats as in the ones above can be used , you WILL include PCC in any counter claim , if he objects or tries again , and you DO expect PCC to pay all costs (inc £155) as they were informed many weeks ago about his illegal activities on there car parks
