Have they told untruths about being in an DVLA ATA?

    YES

    Mr. xxxxx,

Further to your earlier email correspondence with my colleague Ms. Parmenter, I can advise you that ANPR Ltd have supplied a copy of their membership of The Credit Services association which is an ATA registered with DVLA.

    Yours

    Tony Duffy
    Preston Council

    Dear Mr xxxx

The CSA is not recognised as a relevant ATA for the purposes of releasing data for parking / trespass purposes.

    Kind regards

    Liz

ANPR are an ATA member so no lies, have they requested keepers details?

Geez I am on your side but we need to slow down and let them do something wrong first.

He was made a member of the CSA ATA on the 1st April but there must have been weeks if not months of work before hand. You never know maybe he was going to make one of his debt collectors legit. :)

well we have seen several cases of tickets by him over the last few weeks , time will tell , how did ACE get details? no approved ATA but they did,

No one knows why he has joined another ATA maybe he thought he could gain keepers details, but until we see proof he has requested a keepers details we don't know.
ANPR blatently advertise on there website

    "
It is rumoured that ANPR Ltd are no longer members of the BPA and that we've been 'Kicked Off' off their Approved Operator Scheme. I can confirm that the rumours are 100% true. Ironically our membership was due to expire in March and we made it blatantly clear we will not be renewing our £5,000 membership.
As expected we anticipated a change long ago and have initiated our contingency plan."

ANPR , are not a member of a DVLA recognised ATA

" You never know maybe he was going to make one of his debt collectors legit. :)"

may I stop laughing now ,? you have seen tickets (shown on this forum) dated only last week or so , where as a parking management company , the tickets say trespass , (and mention POPLA :rotfl:

I have learnt a few thing out about him , after visiting the police Stn this weekend , if he was run out of town on Friday , it would be 4 days to late

Come on Freddie if Trev said it was Tuesday 26th May 2015 I would check it.

His site is not going to say we have been stymied and cant get keepers details, so you can safely rip your tickets up. He can ticket as many cars as he likes, there is nothing illegal in that as long as he has the landowners permission. There are a few who are not BPA/IPC members who seem to have been around awhile. So there must be enough people who simply pay to make it worthwhile.

yes there are a lot of people that simply pay up , having said that , why has he paid fees to the CSA , and why has he gone from hirer to hirer stating that he is in an ATA , and its DVLA approved ?

there is nothing illegal in that as long as he has the landowners permission

yes , but how is he going to fulfil his contract with the hirer if he is not in a recognised ATA

My understanding is that the CSA is DVLA approved, just not in relation to parking matters.

yes , the correct wording from the DVLA is

The CSA is not recognised as a relevant ATA for the purposes of releasing data for parking / trespass purposes.

however , why has uncle trev gone down this route? to lie to site owners :

Further to your earlier email correspondence with my colleague Ms. Parmenter, I can advise you that ANPR Ltd have supplied a copy of their membership of The Credit Services association which is an ATA registered with DVLA.

by misleading them that he can perform his contractual agreement?

getting data? , as above or give ACE a ring?

    he states"
    The BPA and ANPR

Our relationship with the BPA has been somewhat strained over the last year and reached breaking point and just like many others will no longer endure their authoritarianism. Reassuringly we have always used trespass to access the DVLA manually using FormV888/2 as opposed to the electron link. We have never relied upon the Protection of freedoms act 2012 to rely on keeper liability. Once you can prove trespass the registered keeper is always responsible, after all its their vehicle and the driver is irrelevant.
    04/12/2014

however a parking Co MUST BE a member of a DVLA approved (recognised - see dvla posting)ATA in order to get details , form V888/2 is non applicable to a COMPANY that is listed as a PARKING company

well it gets better , stock answer to the BPA by the dvla

    Dear Mr xxxxx

    I have received a reply from the DVLA;

DVLA do not release data to ANPR Limited for trespass and CSA is not recognised as a relevant ATA for the purposes of releasing data for parking / trespass purposes.

This is consistent with the reply that they sent to you and provides sufficient assurance for me to close this case.

If further information is made available, I will re-open.

    Kind regards

due to the wording being exact , I would say this is a "copy/paste reply

now Mr whitehouse says on his website

    but according to the DVLA

    https://www.gov.uk/request-information-from-dvla

Private car parking management companies can only request information from the DVLA if they’re members of the British Parking Association or the Independent Parking Committee.

so , what is going on?
