Ex problems

Well. My ex took the key to my car (worthless to him) and has it at work. He's currently suspended they won't return it without his permission (police won't help) car is a non runner I need to sell it new key is £200+ And much hassle to everyone. When asked by work he said 'f*** her she's not having it back' :eek:

My garage (which I had no key for he took that too and I had to break into) is full of his stuff which has been there 9 months.

Can I sell some of his crap to replace my car key?

    If he is suspended from work then he won't be allowed on the premise until such time the investigation is completed.
    The rest of the post sounds like two on a power struggle so I'm out.

    They can return it to me with his consent. They told me that and it's from them that I know what his response was.

    I have a waiting buyer offering considerably more than scrap value.

    Edit: I don't see how wanting my stolen property back adds up to a power struggle!

    From my seat I detect two cantancorous persons, anyways as posted above you can sell it without the key (or the new buyer could see if they can obtain the key from your ex) as it seems you both are not on discussion terms. I don't agree with him retaining your property, but there seems to be a lot more to the whole episode.
    Hope it all gets resolved in due course.

    Delain can you sell the car for 200 less and get a new key? Is this an option? I know not brilliant but it cuts the ex out

    My ex won't give it to anyone. He has spent the last 9 months behaving like a controlling ****hole. You're right the key is the tip of the iceberg. I've bent over backwards to accommodate him and his feelings and have now quite frankly had enough. He goes from being absolutely vile to chatting away like nothing happened.

    All I really want to know is if I need to can I sell his stuff without being arrested given that he's had 9 months free storage and won't return my property.

    Or can I contact him and say if I don't have the key by say Friday I will sell *whatever* to cover cost of replacing it.

    It's really not that easy I wish it was. I have now reached the point where I am sick of being stolen from and having the mickey taken.

    Give him warning that you are about to start selling the contents of the garage, see if that helps to concentrate his mind

    I would tell him the free storage is at an end and you will be selling his stuff to cover the cost of the key. see what he does.
    ps - I would sell the dam stuff anyway! sounds like he owes you a lot more than the cost of the key.

    The way you do it, is to give say a month or 3 notice to collect the items, then you are able to dispose of them as you wish (however seek legal direction on this) .

    The Torts (Interference with Goods) Act 1977 states that the landlord can dispose of goods left behind - as long as you follow a certain procedure.

    Firstly, send a letter by recorded delivery to the tenant stating that you intend to sell/dispose of the goods and give the following information:

    Your name and address (where you can be contacted regarding the tenant's collection)
    Details of the items held
    The place where they're held
    The date on which you intend to sell the goods (this must give the tenant a reasonable amount of time to collect the goods, say two-four weeks)

    You must make sure you keep a copy of this letter.
