Hello
I received a charge notice from Ace Securities acesecurities dot co dot uk in March. After googling I had found they are not BPA members and therefore safe to ignore. However, late last week, I had a NTK arrive at my address.
How did they obtain my details and where can I take this now?

...the 'real' name of this company, are not in either the IPC or the BPA.
You need to write to the DVLA and ask the full name of the company that obtained your details. Make it clear that you are not requesting data, nor is this a Subject Access Request, but a complaint into a possible Data Protection Act breach.
It would be interesting to see a copy of the correspondence you've received. Suitably redacted.Je Suis Cecil.0 -

Thanks for the responses, as I suspected.
They are suggesting that they are able to obtain details from the DVLA under trespass on private land? Here are some comms via email, after having written a strongly worded email that I had indeed already asked the DVLA to investigate a DPA breach

No. Only the LANDOWNER can obtain details from the DVLA for Trespass.
Google 'Proserve Pepipoo' and have a read of Valiant's thread on Pepipoo.
Third parties/agents can only obtain details if a member of an ATA, which Ace aren't.Je Suis Cecil.0 -
On the NtK who, if anyone, does it state is "the creditor"?

I will have a look tonight, redact and post the full letter...it's somewhere at home. The woman has a habit of throwing away useless letters that I have a bad habit of leaving laying around.
Thanks ColliesCarer. I have stopped all comms since my dig at using their ticket as toilet paper!
Funny thing is, I had displayed a valid permit but was "parked in a non parking area". As mentioned in emails, I assumed it was a bay since there were white markings on the floor.0 -

Mine periodically collects up all letters that are lying around the house and dumps them on my desk. I then go though them, fish out all the ones that are addressed to her, and hand them back to her!

There's no keeper liability for trespass, only parking, and they can only pursue you for damages caused by the trespass.
If it's a car park, you can also point out to the judge that they are using 'trespass' to get around needing to be part of a trade body to get keeper details from the DVLA.
I would cease communicating with them at this point and wait for a Letter Before Action or court papers which are unlikely to appear, and complain to the DVLA about them allowing the details to be provided.0 -
also worth noting that (if they act quickly with CC papers) the preserve case , not the same , but close is actually at the court of appeal after it was deemed by the DVLA incorrect to gather info , and they actually (well after about 6 mths) stopped giving the info
the next cases we will hear WILL be the ones from ANPR ltd , the timing is just right for there papers to start appearing.
so in a way the COA case with preserve , if it goes the right way , may stop this loophole on the spot.0
