Car parking fine

hi as the registered keeper of a car I received a notice from UKcps that the driver of the car had parked in bay for the disabled. The alleged "offence" took place on 4/4/2015 and I received the notice on 15/5/2015( 6 weeks later). The driver said they did'n't realise it was a parking space for the disabled and there was no notice on the car when they returned to it hence the surprise at the parking notice. Any advice would be most welcome

is/was the car a hire car, or do you have the V5 in your/there name?

if so they have failed to send a ticket out in the required time

Not a hire car. Are'n't they supposed to put a ticket on the windscreen and should I not have received a parking charge notice within 15 days of the alleged offence

Nope - 14 (not 15) days relates to ANPR postal notifications. Windscreen tickets (real or 'ghost') have between 29 and 56 days to notify the keeper that the driver has not responded to the 'windscreen' ticket.

UKCPS 'specialise' in such. You need to get a handle on all of this by reading thoroughly (not skimming) the NEWBIES FAQ sticky.

Come back if you have any queries - after reading.

Did the NTK allege that there had been a NTD (windscreen ticket)? (AFAIK it has to, to be able to comply with POFA requirements). If it did then it is in time; if it didn't then it's out of time.

UKCPS operate a Contractual Charge model, which means that they do not have to account for their losses, (GPEOL). However, this charge is subject to v.a.t. Therefore, if they have not mentioned it on their paperwork or signs they cannot claim that the amount demanded is a contractual charge, because that might be tax evasion. It must therefore be damages for breach of contract o, if they own the land, trespass.

These vat implications could very well be their undoing in court, but the IAS will almost certainly ignore them at appeal as too difficult. Ask the PPC for a vat invoice and if they demur shop them to the tax evasion hot line.

Hi still trying to sort out a pcn. I received a notice as keeper of the car the notice states that a ticket was placed on the windscreen( which the driver is adamant was not there when they returned to the car) how to prove this? Does the make of the car have to be included in the pcn?. Also parking is free in that particular car park. Any advice please

Is this the same PCN you posted about here

If so have you read the sticky thread **NEWBIES!!.... yet for information about how to appeal and a 1st appeal template letter to send?

If not that's the place to start.

You don't need to prove the windscreen ticket wasn't received - in fact it's better not to mention the windscreen notice - the keeper wouldn't necessarily have received it anyway - you just need to deal with the postal notice as the keeper and no the make of the car doesn't have to be included.
