Well it's the same make, model and colour, it looks like my car but I'm going to go out with the picture tomorrow and have a good look. That is a good point. It isn't exactly a common make but there are a few around with the same colour. It's a silver Toyota Previa.
It is a local camera and one that I pass every day on my way to work at 7am. However, it is right where I turn out of a lane and onto the main road and there would be no way I can accelerate up to that speed in so short of distance. I have tried it but the camera is about 50 metres behind before I get up to 20, let alone 36. I would have had absolutely no reason to be driving down that stretch of road at that time of day during the working week or at any time thinking about it.0 -
When at work, is the worked you do logged time wise? Is there any other way you can prove you were at work?
If you have the photo of car have you checked it in detail - if it took the front - is the tax disk in the screen in an identical place for instance. As an older vehicle things happen over the years - broken wing mirror etc0 -

OK looking at this from a fairly independent standpoint.
It's your plates, your model of car, your colour of car, at a speed camera you pass and that is near your work.
Chances of being a cloned plate on identical car = fantastically low.
It's you. Or someone else in your car.
So now is where it gets interesting......0 -

It doesn't matter whether he can prove he wasn't driving, as he can't be convicted for speeding unless he names himself as the driver.
He needs to concentrate either on finding the driver (and returning that nomination within the required timescale), or on proving it wasn't his car.0 -
Where is your car parked at work? Is it covered by CCTV? Act quickly if there is chance of evidence of your movements as old images can be quickly overwritten.0

The alleged offence took place during the day while you were at work.
Where do you think the car was parked at the time this alleged offence took place?
You proving you were not in it at the time does not help you avoid a penalty - you wont get a speeding fine - but you will be prosecuted for not supplying the requested info.
Who else has keys?
Your partner? A teenager?

My car was photgraphed by a GATSO machine doing 36 in a 30mph zone. I know it wasn't me driving it as it was in the middle afternoon on a weekday and I am sure I had no holiday booked at that time and I wouldn't have any reason to go out in my car during working hours. I have no idea who was driving it and enquiries have drawn a blank. Obviously I have written to the NIP issuer explaining this and complied as far as I could with sect 172.
Now they have written to me to say that the case has been passed to the Summons team for further action. Is this normal or should I be worried?

Be very careful how far you take this unless you are absolutely adamant that it was not you driving, your comment "and I am sure I had no holiday booked at that time" is a little strange, albeit the offence was only up to 14 days ago, likewise trying to prove or disprove how your vehicle couldn't possibly build up speed enough from your normal turn out from a side road, this is also at odds, with the "It wasn't me, I wasn't there" ummm.
I remember having dealings with a similar incident where the driver of a vehicle stopped for a serious offence, failed to appear in court and alleged it couldn't possibly be him or his vehicle, and he lived 50 odd miles away, and the incident occurred early hours of the morning.
He went to great lengths to change the number plates and have a cross of St George on, add some reflective tape on the bumper similar to wide load stickers, a large aerial and some furry dice, all this on a two year old 5 series BMW ? and on a home visit, he had also changed his hair colour and style to a blonde, gelled spiky number, scruffy jeans and tee shirt he looked really odd for a 40+ man, although Rod Stewart got away with it for years !
But a visit to his work premises (company vehicle) was hilarious, on the back of his office wall was a proud photo of the smart dark haired, "innocent" businessman resplendent in suit and tie, looking very proud receiving a sales award from a celebrity at the works bash, not the beatnik type character sat in front of us, even his secretary thought he was going through a crisesit didn't end well for him, but the offence was not speeding and was far more serious, but the same eye for detail may well be applied ? but if your sure it wasn't you, then best of luck.
