Speeding Summons?

My car was photgraphed by a GATSO machine doing 36 in a 30mph zone. I know it wasn't me driving it as it was in the middle afternoon on a weekday and I am sure I had no holiday booked at that time and I wouldn't have any reason to go out in my car during working hours. I have no idea who was driving it and enquiries have drawn a blank. Obviously I have written to the NIP issuer explaining this and complied as far as I could with sect 172.
Now they have written to me to say that the case has been passed to the Summons team for further action. Is this normal or should I be worried?

How many people have access to drive the car, for most cars its only 2 or 3 people. Seems a bit unlikely that the driver cannot be identified0

This is quite normal, as they will simply prosecute you for failing to identify the driver, which is a very hefty fine, 6 points and eye watering insurance for the next 5 years.

Both. It is normal, and you should be very worried.
Unless you name the driver you will be charged under S172 and probably found guilty. Heavy fine, costs, 6 points and a code on your licence
which will seriously impact your insurance in future.

But I have absolutely no idea who was driving my car! No one else has access to it other than me.
Yes I can understand having to name the driver under S172 but what if you can't? What if some neighbour has found that his keys fit your car and nicks it to run an errand and then parks it back where you left it so you don't know? Or what if the former owner has kept a spare key and comes and drives it every now and again?
Ok, I admit that these scenarios are unlikely but S172 is a bit like the police arresting someone and threatening to jail them unless he can name the burglar!0 -

You are the Keeper.
This is a Very Responsible position to be in.
The Law supposes that you have a very good idea what the car is doing, and who is driving it.
The onus is on you to prove that you don't, without appearing to be irresponsible. It is a very high hurdle to jump, as the Magistrates have heard it more times than you have had hot dinners.
I assume that you agree that it was your car, and have discounted the possibility of a simple misreading of a dirty number plate, or misskeying of a digit by a clerk somewhere, or even of your neighbour, or former owner having copied your number plate onto another car?I want to go back to The Olden Days, when every single thing that I can think of was better.....

Was the camera local? Sounds like cloned plates to me, I'd ask for the photo and check for differences In the vehicle pictured and your own0
