Thanks to Martin's fantastic advice I have successfully reclaimed £1000 for PPI payments which I did not realise I was paying. I took out a loan over 2 years ago through Halifax Plc, I had always assumed that I had not taken PPI cover as I never bother with that type of thing. After looking through my paperwork I discovered that I was paying PPI! Halifax has responded to my claim and admitted that I never signed the box confirming that I wanted it! yes I was stupid not to check the paper work at the time but surely they have sold me something I never wanted, therefore can I expect some compensation on top of my reclaimed payments?0

They will not budge on giving us the refund by cheque.I'm really annoyed because other people have had theirs by cheque.Now emailing the MD.
bearing in mind julie i rang the FSA they said you are in your rights to contest it it may be there company policy but you can argue

Back ground to my case:(as posted back in Dec 07)
Bought a car from a local garage back in 2003 and they included PPI - I paid off the car finance in full (issued by the local garage) in 2006. I had medical conditions at the time but the garage sales person did not ask me about them. Also I was strongly lead to believe that having the PPI was part of the car finance and without agreeing to it I wouldn't have been able to purchase the car.
Well done to you for going after them, it takes guts!

I am no expert on this but on the verge of doing two court claims, trying to pluck up courage!- Use negligence under Misrep Act 1967
- What training did the sales person have to be able to do all the advising they are speaking of?
- Due to recent media attention you have been made aware that PPI is optional and you have been missold as also not been given the details of what policy covers etc. Why else would you wait 3 years after the end of the settlement of the finance in which to claim.
- You have suffered loss as you were unaware of the true cost of PPI and could have obtained cheaper elsewhere and also as policy close to useless as would not have covered existing medical conditions.
- You were never asked about medical conditions or advised of disclosure of existing medical conditions, if you had have been you would have not opted for the insurance (if you were aware it was optional)
- Where they quote "contract of utmost good faith....." chuck that back at them as you also relied on this and trusted them to advise you correctly and not imply that ppi was essential in getting the finance.
- The garage that sold it to you must have some guidance of how to sell and advise etc. The finance company is a member of FLA. Have a look at this link http://www.closemotorfinance.co.uk/info-06.htm (see RELEVANT OR RELATED LEGISLATION)
- Consumer Regulations they refer to is here: http://www.fla.org.uk/fla/consumerfinance/ConsumerCodesofPractice.riv You need Code of Practice 2002. If they sold on behalf of finance company mayve they should have been using this?

I have finally looked through my Capital One details again, (I claimed 200.00 in bank charges from them last year) And when they sent me all the details of my account it had a copy of the account opening form and I had ticked on it that I did NOT want ppi, As I had, had my daughter and was a 'Homemaker', My partner is self employed,
However after going back through my statements I see that I started paying ppi in 2003.And have done ever since,
I've had lots of health problems so have not gone back to work since having my son so would not of signed up for ppi, and to be totally honest I really do not remember asking for it or agreeing to it,
What should I do now? I know its only a little over two pound a mth but it all adds up!!!

I have stated our complaint ref and details of the loan including PPI
explaining we did not know the PPI was optional or that we were not advised of taking out PPI on a monthly basis instead of the single premium or could take PPI with another insurance company.
said we were reviewing our finances in sept 07 we were surprised at the settlement figure stating figures that the original PPI was 17143.00 the rebate was 3949.36 + approx 12 monthly instalments on average 150.00 so for one years insurance it had cost us 14994.64.
then I stated the the mis representation act.
then I finished off with saying we had settled the loan but the final response from their complains dept said it was not missold
saying we think the single premium they offer is not fit for purpose as we had taken the loan out over 25 years but the PPI only covered it for 5 years also it was not made clear to us that we would be paying the PPI over the full term of the loan.
also saying regrettably we have had to refer it to FOS as the complaints dept can no longer enter into any further correspondence
the ending is the most difficult as I dont know how to word it.
Here goes
we would like you to review our complaint of missold and also this would include reviewing the rebate we recieved on the settlement we paid.
we hope you can resolve this situation
we look forward to hearing from you in the near future.

they said that to me initially but stuck to my guns and said was willing to accept ONLY on condition i recieved a cheque if not it stays with the FOS

Its all done now.The first rebate is coming off loan (1,500)

After hearing about the PPI reclaiming etc, I thought I'd give it a go.
Sent the first template letter to Egg (Unfortunatley my letter is saved on my old comp which died!!)
Their final decision reply came yesterday.
Basically it says:
What I understood your complaint to be about:
You believe that you were mis-sold PPI cover when you applied for your Egg loan.
What my findings are after investigating it:
I have tried to trace the original phone call during which your loan application was discussed. Unfortunatley, I am afriad that I have been unsuccesful in finding the call on this occasion.
Egg is conscious of its duty as a responsible lender and will always tailor the loan to the circumstances of the applicant. Insurance will be offered if is thought to be of benefit to the applicant. The level of cover offered will be reliant upon the information given at the time of the application by the applicant.
The script that the associates must follow will always require them to ask the applicant how they are employed and what arrangments they have in place to meet commiments in the event of unemployment, sickness or an accident.
The information regarding the cover would have been included in the agreement you recieved and signed.
The agreement does cover the 30-day cooling off period for the PPI at which time you can contact Egg and we will cancel the policy from the account.
I am sorry to inform you that I do not accept your complaint.
Even though we do not accept your complaint, I still need to ensure that you are aware of your rights in relation to a complaint against us.
You now have 6 months from the date of this letter to take your complaint to the Financial Ombudsman Service.
If you want to discuss blah blah blah please contact us etc etc.
The claim is for two products. An egg credit card- paid off and an Egg loan whch is now a charge against the house.
What would you suggest the next step be?
