Have just contacted abbey with regards to claiming back MEAF and they can not find my mortgage, however, they have found some form of Policy insurance called a LCP??

I never knew I had insurance with them, so maybe this is another PPI claim.... who knows
  • I have started down the process of reclaiming credit card charges. I was being charged both over limit and late payment charges for several years. For a large part of the time I was also being charged PPI on the total outstanding balance. When I started to rectify the situation I cancelled my PPI. I also found out that I was only covered up to my cc limit but being charged automatically for the full balance. Will it be possible to reclaim the difference between the cost of the amount of cover and the actual charge?
    Regards

Ok the first question here is if GE money have the information you should be seeking the CCA (Customer Credit Agreement) from them. The second is check out the limtations act 1980 especially this link:

    http://www.emplaw.co.uk/researchfree-redirector.aspx?StartPage=data%2f0107201.htm

Which specifically say a normal contract is 6 years. Hope this helps. By the way that is six years from the completion of the contract, you can do the sums two ways if you have settled claim the whole PPI plus 8%. Or you can do sums and work out how much extra has been charged due to the addition of the PPI.

Ok, well I am within the 6 year period as we took out loan in July 2002.

What info do I need altogether to issue a claim?
Is it just the Customer Credit Agreement?
Can I request this information by phone?
    Thanks for your help.

Yes you need your credit agreement send a letter requesting the information (registered letter) as by the Data Proctection act 1998 you are intitled to all information contained on you by any party if it contains any information of a personal nature. You probably need proof relating to how you were mis sold ie you had insurance already or you can us the fact you were co-erced into the PPI when its therefore your word against theirs however if you use the Mis representation Act 1967 particularly in the area relating to negligency its up to them to prove they didn't mis sell you the policy.

    thanks for that
If the £2021.33 was added at the start of the loan, does this really mean that I would be paying interest on this for the whole 15 years of the loan?

Well although no luck as yet with FirstPlus, have received phone call from HSBC refunding me £1350.00 for a loan they missed off first time I claimed. They have now paid me almost £4000 altogether, stating that they have no paperwork and I sent off my contracts of employment stating that I only worked 10 hours a week no enough to claim, I got everything back including interest and 8%. Thank you for all your help. Now just keeping going on First Plus.:j :j :j :j  :T  :money:
