Hi am waiting for a response to my second letter, does anyone know how they work out the 78% rebate, is it worked out on the whole amount of ppi paid or does it relate to how long you had the loan before you paid it off.

I'll make it simply. Anything they offer you isn't in your best interest to accept. Because unless you get back every penny you gave them they are ripping you off if you were mis sold. Their working out is 78% not including interest or any additional charges plus they will offer to take it off the loan if you decide to re finance the loan (don't do it). The FOS can force them to reply you everything that you have paid plus interest plus compensation and make them re calculate the loan without having to refinance.0 -

FOS tells me DFS were not regulated by them at that time (cant find out who they were regulated by). I want to take them to court and although I have the original paperwork, I do not have T&C. The amount is only £240 and it was a long time ago but it is my money and I cannot believe I have been conned out of it so really want to fight to get it back!!!!
I am a partner in a business with staff so have an income whether I go to work or not and would never have opted for PPI as payment was only £46 per month so was unaware of having it.
Sorry it is so long winded, but does anyone have an opinion on whether taking DFS to court would have a prospect of success?

Have you checked all these companies:

If its not in these then they're credit agreements must have taken by another finance company and its these you should be going for not DFS. They have to provide you with you're old CCA (Customer Credit Agreement) or Terms and Conditions, if you request them, within 40 days. If they don't call up the information commisioner and get involved remember its not the amount its the principle.0 -

Thats the problem the money and finance was by Nova. Effectively they bought the sofa off DFS and then sold it too you and therefore it is them that you should be going after in this case.

I guess so have also checked the small print which have on some peoples policy you can't claim if your self employed then. Just keep at them they will fold in the end.0 -
Hi, We have written to Blackhorse asking for all ppi back as we didn't want the cover and were told that we had to have it. They have said no to our request so we are about to take this to court. All along our arguement has been that we were told we have to have it when we didn't want or need it. We have also just realised we have been charged over £2000 for it when we only had the loan for 3 months before settling early. We have never mentioned this in our letters. We are about to send a letter saying we will take this matter to court. What arguement should we use:
* We were told we had to have the ppi in order to get the loan
* We were not given a fair rebate on settling the loan
* Both!
We have never mentioned the Misrepresention act 1967. Also is there some sort of 'act' we can use for the little/no rebate arguement. When we do take this to court will we need an 'act' to back up our arguement.
Sorry for asking so many questions, we just want to get it right.

Yeah, thats them. Just found some info on investsigations on them and looks like part of it relates to PPI. Will have a good read of it and post info on thread if relevant to reclaim.PPI Reclaimed -
