hi,
havent seen barclaycard mentioned anywhere and ive scanned a fair few pages. could anyone tell me if i can claim against them, i know i have been paying ppi as i have my statements from when i claimed the cc charges
what im not sure about is
1)when i opened the account, it may have been upto 10/12 years ago
2)whether i opened it in person at a bank,or just with an application form
3)if i was asked/informed about ppi,
obviously if i dont know these things i have no proof?
i suffer from epilepsy so would that be a factor, also in full-time employment
any help would be appriciated

Regarding the requirement for 3 years that's absolute rubbish as they have to keep records for Corporation Tax & VAT Purposes going back 6 years plus the current tax year are they therefore, admitting to failure to maintain records in accordance with HMRC (Her Majasties Revenue & Customs) rules

Another question......Just wondered what the 5 year refund thing was all about as well, I 've read in some posts that if no claims are made on your PPI after five years, then you can claim it back, havent a clue what this is all about?0

In response to your letter of 1st February 2008.
First of all the critisism from the FSA are on failures in Good Practice.
Thank you for your letter as it basically admits to failures in good practice and will be used as evidence in our county court case.
I am shocked you have no records pertaining to our loan agreement as records have to be kept for Corporation Tax & VAT Purposes going back 6 years plus the current tax year, are you therefore, admitting to failure to maintain records in accordance with HMRC (Her Majasties Revenue & Customs) rules.
We are requesting a full refund of the premium and subsequent interest on these payments made to date.
As we believe we have been deprived of this money we also expect 8% satutory interest, the amount a court would award to be added to each payment made.
I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.
If you dispute that I am entitled to a refund of these payments, I request that you forward within the above mentioned time scale, a copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions. These are requested under CPR Pre-Action Protocol 4.6(c), and failure to provide them will be brought to the attention of the court, should it be necessary to commence a county court action.
If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.
After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline.

Hmmmmm, sounds strikingly similar to my original telephone conversation. Really not sure what is the best advice to give to you, but as they have offered you some sort of rebate, they must think that you have a case! Do they say anything about the total amount payable including all the interest for the ppi? They never mentioned it to me. After listening to it back, are you absolutely sure they pushed you into taking it out and do you think they never disclosed certain information?. If you are, then I would stick to your guns and keep fighting for more. There is something mentioned in one of Martin's template letters about asking them to reconsider the amount of refund "without prejudice" meaning that they cant go back on what they have already offered you.
If I were you, i'd wait to see what tiggrae and m.colak have to say about it before making a decision.

with a lot of help and advice from tiggrae (thank you)I have decided to refuse the offer from first plus will send them my response tonight and see what happens i want them to breakdown the figures 78% and 22% and also the insurance was not appropriate for my needs my husband should have been the first policy holder if advised correctly although agreeing to the policy i felt pressurised in to doing so. still havent decided to go the hole hog or offer a compromise thanks to all who have given me such valued information will keep everyone posted they will have 1 week to respond

I've given them until Tuesday to meet my requests and have said that I will start court action immediately if they dont. They haven't sent me any tapes of the phone conversations even though I asked for them. If they no longer have them, then I would win by default at court as they wouldn't be able to defend themselves as they need to prove that they never mis-sold me the policy.:D When did you take out your loan? Ours was in August 2005, was yours after this date. I wonder how long they keep the phone calls on file for?

This sounds all too familiar, I'm in same position as you, but with Freedom Finance, they told us they no longer have any of our details, I too would be interested to know how long they keep the phone calls on file for.

Thanks Tiggrae, I've read what the FSA have to say on the subject of refunds if paying back a loan early and they say that they can't give a single policy for all firms as firms may need to cover their own admin costs etc. It doesn't give any guidance to what is considered fair refund - my contract states I'll only get 8% of the PPI back if I pay back the loan 3/4 of the way through but I feel that a pro rata refund is much fairer.
I was thinking of phoning the FSA on this point tomorrow - so I'll let you know what they say, unless you have any other advice on that point?
The other point, which would supercede the above point if I'm right, is that I wasn't told that I could obtain PPI elsewhere, is that a duty of a salesperson when they are trying to sell you PPI?
