    Ahhh this explains a little bit why they are a little slow on giving you're money back and for a small percentage i can help..... only joking really. At this stage you have to make a decision:

    1. Go via small claims and claim up to £5k but know that the company can't claim costs against you if you don't win.
    2. Go via normal courts with a solicitor where the costs could be greater

    It's really a decision on whats more important to you... getting the moneyback with the minimum cost to yourself or making a big point against black horse. I can't advise you one way or the other however i would always err on the side of caution if its close to the £5k mark.

    No still hasn't come am very impatient now. Poor wife couldn't sleep very well last night as junior was kicking like hell. Spent most the night cuddling her and tell her how wonderful she is am knackered as had to drive home last night. Am off work now for 4 weeks to help.

    Sorry that just sounded weird work away from home travelled home last night and spent the whole night cuddling her and telling her how wonderful she is. Makes better sense now.
  • hi there funny that i too was wondering if your baby has arrived yet....i have sent black horse a copy of my N1 form for court and have filled in the EX160A form which will exempt me from court fees due to the fact i claim working and family tax credits, don't know if black horse think i'm only joking but gave them 10 days from 5th jan and still no reply so its there choice the forms will be posted on wednesday

    GET THIS - The Mortgage advisor does not discuss the TERMS and CONDITIONS of insurance policies, as at the time of interview with customer the insurance policy is not accepted. If accepted the agreement is made between customer and insurance company.

    They then go on to say that Barclays Insurance Dublin would have sent us terms and conditions I dont remember that as I thought they were on back of policy which I have - no mention of self=employment at all and then they say we would have signed this to agree.

    Bla Bla cancellations rights then get mentioned certain time to cancel

    They go on to finish with - Given all circumstances, I am unable to uphold your complaint about your Insurance Policy was mis-sold

    I am sorry if this is not the outcome you wanted Bla Bla Bla............
    .....They then say I can go on to FOS

    What do you think my next step should be because Im not giving up that easily !!!!! :confused:

    Hi Again can anyone help with some advise for next step please !! I have contacted FOS said could have case and wrote 3rd letter to Barclays saying not happy with final response bla bla bla have I done enough if so I shall wait and see. All paperwork is copied and waiting to go!!

    As long as you have given them plenty of time to answer the claim don't worry as you are still in the right. Good luck and keep us posted as i will you all about the baby.

    It sounds like your ready to go and you have exhausted all reason with barclay's. The only thing i will say is be aware that going via the FOS will mean that the case will take a minimum of 3 months to get sorted. CHeck your financial position and how much the claim is for and then consider going via the small claims courts for quicker action. This isn't saying you would be better going via the courts its just saying that you still have that option. I would send another letter to barclay's about your decided course of action and as tiggrae states (very wise person) utilise the 1967 misrepresentation act as its there for our protection.

    can i borrow you my husband didnt do anything like that when i was due he just slept. even on labour day he had to have man flu. you sound perfect

    Thank you but i'm sure my wife will tell you am far from perfect (very far probably about morecombe to be honest.)
