OK a few things.
In the meantime examine your policy - does it state anywhere that they will not refund the PPI upon early redemption of the loan - if it does then the FSA (financial services authority) have stated no refund or partial refund terms to be unfair under the Unfair Consumer Contract Terms Regulations of 1999. Go onto the FSA web site type in ppi and the 5th or 6th item has the FSA ruling - send them a letter copying that in, stating their wanting the £961 (and sending it to a debt collector) is unlawful as the term they are using to claim the money is unfair under the UCCTR and you want it cancelling !!!!
Hope that helps
Sorry to sound so dumb, but i have been on the FSA web site and can't find the FSA ruling you mention.0 -
Hi all,
Bit new to this.
Can any one help. Does anyone remember who Monument Credit Cards took over from?, I seem to think they were not the original Company.
Sent first letter to them and got a reply saying the payment break plan is not insurance and therefore not subject to GICS ( whatever that is)?.
They also state the acceptance or non acceptance is done on the inital phone call ( this would not be the case if it was another compamy first). they also say they can find no trace of the phone call in their archived data.
They have however offered a goodwill gesture of £237.68 this represents the amount charged between 10th feb 2006 and january 2007 the last year I was paying it.
Do I accept? accept and carry on with second letter.

Hi there, We bought a Sofa 2 years ago from DFS on and interest free deal, 1st year there was nothing to pay and the next 4 years were interest free, I've just double checked and it seems the snuck in a PPI in the deal which I definately didnt agree to as I never have (found out about them a long time ago) I am going to claim that this was missold (as it was, I was never told about it buy the guy in the store who virtually filled out the form for me) but just wondered if anyone had any experience with this sort of PPI rather than one attached to a loan (even though in theory I guess this is just an interest free loan)
thanks

This is the name of the document you need - it's now 14th on the list when you search for ppi on the FSA website

I posted my story in the "successes" section of the site on 24/11/07. Going a bit deeper and having a good think about it I`m now not so sure. Can anyone out there help.
My offer from LTSB for a £25,000 loan, taken out in Nov 2004 over 7 years, was £ 5,705 plus interest on an ex gratia basis and the money would go towards reducing the term of my loan. The monthly repayments however, stay the same. ( I still have the PPI with them )
On checking my policy the £5,705 figure offered is the total premium for the life of the loan, although, as I said, they still want me to continue with the same monthly repayment !
Can someone point me in the right direction as I`m confused ( and suspicious ! )0 -
Hi all
I had PPI and when tried to claim was told I had to be out of work for months before claiming, had I been told this I'd never have taken this pointless cover out.
When trying to cancel they wouldn't let me, had to re-apply for the loan and was then declined (even though circumstances were much better etc)
Have just received a stock 'we have received your complaint' and will be back to you shortly.
The loan was for £7500 over 4 years but was paid off after about 2 1/2, I've found paperwork for the settlement and it says on there 'you may be entitled to a refund of part of your loan PPI premium'. I don't even remember getting this I remember thinking the settlement was really high as the balance hadn't reduced much in the time I had it.
Glad to see others are having success with Lloydstsb, I just hope I will get the same luck and don't have the usual battle on my minds which I always seem to get
Does anyone have feedback for Lloyds? It's took a month for the stock letter and the MSE template I used gave them 8 weeks dragging this out till next year. Any inspiration most appreciated0
