the bylaw thing is simple , (and I will get slagged for simplifying it) the place you parked (if correct) is not land that people can issue tickets on , the charge must be (simplified) trespass , and that should be issued by the land owner , not a parking firm

your only letter should be to the debt collector , saying "get $%^&$%" , or simular wording, DO NOT ring or write to armtrac , let them write back to you , if they feel they have a case , at which point you can mention the fact that they are breaking the law , and you can then report them for (simplified) trying to obtain monies by deception etc

many of the wordings have been simplified to make it easier for the OP to understand

    Thanks guys,

Is it best I write the above letter to TNC as I don't want them harassing me and also write to armtrac with the initial appeal post from the sticky.

TNC will not take much notice of anything you write so you will eventually need to complain to the CSA

Thanks freddy, I appreciate the simple language.
Mark, when you say unscroupilous what can I expect?
I have no knowledge of this and don't want people knocking on my door as I have teenage daughters and don't want them worried by something like this.

Is it best just to send the letter I included at the top of this post to TNC directing them back to Armtrac

Especially as I have had a missed call from them

write to armtrac , saying the above , if after say 7 days they contact you in any way , you can legally hit them with a harassment claim , and get them into serious do-da ,
  • Sorry freddy, do you mean TNC? they are who the letter is from. Armtrac are the alleged ticket issuers

Unscrupulous in that they have decided to send a threat for money without any ticket.
This is how they work, they probably send hundreds in the hope some pay up.
Personally I would not take them seriously and wait to see what they do next.

I am quite sure like all parking companies they have seen every scary threat letter by return post going and like other parking firms, will just see it as a bite and someone they can work on.

They only have so much time and therefore they will concentrate on those who answer back to them.
I do Contracts, all day every day.

how did they get your phone number?
  • don't know, somewhat worrying as it's my mobile number. House should be x directory
  • Sorry guys, I have two conflicting views here,
If I answer, do I get to start the appeals process?
If I ignore can I expect endless phonecalls and letters.
