Credit card maxed out by someone else...not stolen but without permission

I imagine unless there is a trail to him then it will be difficult to prove who made the purchases. Hopefully some of the items were online purchases addressed to him. Shop purchases would be more difficult to prove as the user must have had the pin and it does clearly state when you receive your pin not to share it with anyone0

That is the pertinent question the OP needs to answer.

The fraud/theft debate is probably a bit of a digression. I think we need a bit more detail on whether the "emergency" card was ever there for the bf's use and if so on what basis. And then look at whether we can say the transactions were unauthorised.
As far as she's aware, he wasn't an additional cardholder on the card. And he never used the card before they broke up. I imagine that she needs to get hold of all the statements to help her with this?

As she is the primary card holder she would have needed to authorise a second card holder - so she should be aware of having done this. However now of course its possible with some banks to simply apply for an additional card holder on line. So if the ex had her online credit card account details as well he could have logged in asked for a second card and requested a PIN reminder as well.
Obviously we don't know all the facts - but in this age of online access fraud is far easier to commit if you let people who are untrustworthy have access to your bank or card details.0
