Unfair Penalty ticket , Help please !

Thanks in advance guys , I am living in residential area with allocated car park for each flat.
I have lost my private permit which was stick on my front screen on my way back home few weeks ago ,
parked my car in allocated car park around 10 PM.

In the morning saw the ticket on my car which issued by private company which controlling my area about 2 hours after ( 12 AM !! ) .

first thing in the morning I called the other private company which issuing permit holder and asked for replacement and they charged me £10 .

I send a letter to the private company which they issued ticket and explained to them that I parked my car in my own allocated bay car park and car registered in my name and my address. they refused and they said I should contact them know as they have sign with telephone number, I checked the sign and nothing is about If I lost ticket I should call them ,, also in last 12 month I am living here I never receive any letter from them about their rules, 2 different companies dealing with this area , one for issue ticket other for permit holder.

please note I parked my car around 10 PM and they issued ticket 2 hours after around 12 AM ,

They sent me a from ( POPLA ) to appeal and they saying they will charge me for £100 instead of £60 if I appeal to POPLA.

I have letter from other company which confirmed I paid £10 for replacement of my permit,

I feel this is unfair penalty and I did lost my permit, I parked my car in my own car park, really unfair ,

Please help and advise me for next step , should I write to them again to appeal to POPLA , are they going to help me ? are they allowed to increase the charge from 60 to 100 ?

    First thing is to check your lease to see if the agreement requires you to display a permit. You will suffer this pestilence for years to come if you don't get this common problem sorted.
    Then read the NEWBIES section at the top of the this forum and find through the forum search similar cases with the same PPC.
    Come back for more expert guidance when you have got your head round it.
    Ignoring is not an option, these things need fighting.

    Thanks for reply , of course I should display but I didn't have it and lost it ,

    Also I did search in forum and no one has same issue as mine ,

    I have dedicated car park and I parked in my own car park ,

    Post one of the newbies sticky deals with your situation exactly - please read the thread carefully.

    It help a lot if you told us which company issued the original ticket as we will probably have seen them before and know their MO and potential weaknesses well. :)

    There are also a great many private permit-related threads in this forum but only look at recent/post-POFA ones.

    Er...

    Concerning their threat to increase the charge to £100: It might be an idea if you could either scan the letter or type it out exactly how it is, word for word. I mean this with the greatest of respect but I get the impression that you are either a person can have some trouble expressing themselves through writing or that English is not your first language. I think a copy of the letter should be forwarded to the BPA and also another copy should be enclosed with your POLA appeal too. But let's see it first. I think it might be illegal to issue such a threat but it would depend on how it's worded.

    here is part of increase charge

    "you may either pay the charge notice at the prevailing rate or appeal to POPLA, the independent Appeal Service , by completing the accompanying form , please be advised if you opt for independent arbitration of your case, the charge will increase to £100."

    I'm sure that someone cleverer than I am will come along but for now I suggest the template letter in the newby's thread. If that doesn't work (and it won't) wait until the debt collectors' letters start and then ignore them. :D .

    IF they take you to court you have a letter in your possession which indicates that the increase in the charge is because you had the effrontery to exercise your right to ask for an appeal.

    Yes being a tenant gives you important rights. Your lease may show that the PPC may not have the authority to issue PCN's on your property.
