Finding It Hard To Cope Its just a vicous cycle

Thanks for the well wishes but CAB could not help.
They called the courts and the courts have gain stated that there is no record of me calling in to confirm I had started to recieve my benfits and that an agreement was made, and that all calls even if to ask basic question are logged on the system. They stated the last call they had from me was in March. When the CAb advisor read out my Itemised bill for April showing a 5 minute call to them they have apologised and advised I should write in and complain but they could still not pull the debt back from the bailiff.
The bailliff again turned down my offers through the CAB and advised that they were about to release the debt to the actuall bailliff to call....Bad news being (and confirmed in several sources) they have a full warrant and would be able to break in to remove goods.
They stuck to the guns and demanded £40 a week for the £235 bill out of my £72.50 incapacity benefit. I have had no option but to agree these terms.0 -
I posted off for my credit file on Thursday. Today even more bad news:-
I had an overpayment of housing benefit (£127) some years ago and until recently they were taking £5 a week from by benefits. A couple of weeks ago they stopped my benefits due to me not returning a form (which I never recieved to return) any way because of this the housing benefits wrote to me saying I owe £111. I explained why it had been stopped and that it had started again. They advised they would re-apply. Today I got a Letter saying they were going to take £32.27 a week from my benefits. I called them to ask why when it was only £5 2 weeks ago. They then sprung on me that I had been overpaid by £70 in JSA in 2004 and they were also going to take this from my benefit. I lost it on the phone, demanding to know why they had not written to me to confirm this and if they took it without confirming I would seek legal action. I then explained that from my £72.50 Incap I had to pay £40 to the courts, £32.27 to housing benefit and £10 to JSA and asked how they planned to do this when clearly I dont get enough benefits and even by their pittence of a suitable living allowance they would be leaving me in hardship.
So these have now been put on hold and they are sending a hardship form or something for me to fill in so they can evaluate what they will be taking.
GOOD(ISH) NEWS
My solicitor is having talks with my specialist about my claim to see what can be done with regards the fact that they can possibly be getting away with paying me £2K instead of the expected minimum of £20K we were expecting. I will know on Monday what the outcome is. However before the medical evidence turned in their favour they sent my solicitor an Intrim payment of £2K so if we cant do anything the cheque will be posted to me straight away. And if there is something that can be done, as the cheque was an Intrim payment the cheque will still be posted to me.
I have decided that if things fall at me getting just £2K I will wait till the cheque clears and draw all the cash and go bankrupt ( any help or advice would be great, especially if I can take my wifes debts with me).
Also today the ex has advised me that she is increasing my access to my first 2 children from 4 hours on a Wednesday to the 4 Hours on a Wednesday and then from end of school on Friday to Saturday evening....Buzzin about this.
So anyway if any advice available for Bankruptcy I would be greatfull, all advice of course but especially regarding:-
1) Can I take my wifes debt with me?
2) Would this cancel out all debts including the courts costs etc?
3) How can I ensure that all the goods can be seen as my wifes and not mine? A Bailiff once told me that unless she had reciepts showing that she paid for the items (i.e. card payment) that they and liquidisers can assume that everything is mine.0 -

Even if you felt you had to agree, you should still write and make a formal
complaint, with a copy of your itemised phone bill. it is plain that some-one has not logged your call, so you should demand redress.If you've have not made a mistake, you've made nothing0 -
I'm no doctor but I can't help thinking that relying on morphine to get through the day is not a good thing. It was my impression that it is only to be used as a short term measure - is it not possible to see a specialist on the NHS so you can get your back sorted? You're only 30 as you say and you don't want to get dependent on morphine.0
