    Glad to see you're feeling a bit positive today - as anyone who's been experienced depression knows these are the days to get loads done!

    When the CAB phone back, check with them about the rules regarding debtors taking money from your benefits - I'm pretty sure that they're not allowed to as this is money that the government has decreed is the minimum you can afford to live on!

    I did wonder with your wife's debts though whether she's on an IVA (it was the mention of a government thing, which crops up often in the TV adverts)

    The court fines are definitely the priority debts right now - esp as the confusion about whether the bailiffs are coming round or not will make things more difficult!

    I think a full SoA including both yours & your wife's debts will help us advise better - to be honest if between you they're high without much opportunity to pay them off then you might want to consider bankrupcy.

    I believe that to be the case too.

    Do look into it, and if you can come back with a definitive answer for the gang that would be great, as there are many people in the same/ similar boat to you who would benefit from the info

  • Hi Guys Sorry for the lapse in time, family needed seeing to.

    The CAB phoned back and have asked me to go in to see them in the morning. I wish I could say that it sounded positive but to be honest I think I got a young newbie (no disrespect) who felt it was better that someone with more knowledge answered my questions.

    I will update with all the info I can and hopefully it will help others as well

    You can't use those court forms for the fines that you have got.

    The N245 and the EX160 are for use in the (civil) county courts. You have (criminal) magistrates court fines. That's why the forms are no use.
  • Well off to see the CAB today. Will also be sending for my credit file from Experian (will do the others when I have the cash).

    Just wondering though, if I decide that Bankruptcy may be an option can I take over my wifes debt first. This way at least one of us can have a clear name?

    Have followed your thread ofr alittle time and am very glad to see that you are feeling more positive and able to cope. Like you, I have an issue with my back - but not in your league.
    My nephew went bankrupt after uni - he had got himself into desperate trouble with credit cards and student loans etc. To be honest, it was the best thing that could have happened to him. He has now been discharged - the five years go very quickly, and it has allowed him to get his life and 'head' together.
