Every chance and they will certainly go back to the point when the couple first claimed the income related benefits and made the mistake0 -

And if it is seen that the 'gifts' were made recently I'm not so sure they couldn't chase to get those back either.
Bottom line is that a major fraud has potentially been commited and it's likely that there will be in-depth digging to recover what can be recovered. General rule of thumb if prosecution isn't considered the best way forward is repaying all over payment +50% 'fine'.0 -

It depends on how much they've received in means tested benefits in 5-6 years.
If they weren't entitled to receive any because of their joint income and capital, including savings and investments...then everything they got would have been an 'overpayment'0 -

I am sure the council will be very happy to tell them once they have all the facts, any case it doesn't matter how much the overpayment is it still has to be paid back0
