What a mistake.......... help!

    i thought the 14 day cooling off period was for after a contract had been signed and therefore the contract is deemed not to have been agreed if you cancel and therefore no clauses in it can be enforced, because there is NO contract?

    Correct. Somewhat.

    There's distance selling regulations (which used to be 7 days), but i read this changed so it may well be 14 now. - if the contract is signed at home (or posted to the client)

    If it is signed in the office, then the 14 day cooling off is whatever the clause states.

    First of all thank you all so much for the advice, and being so understanding. I have to say I was expecting a lot of nasty remarks from some people!
    (obviously the nasty people didn't read my post thank goodness.)


    I went in to Estate Agents today, and I have to say they were very understanding, the agent who signed me up wasn't there, and won't be until Monday. I handed over my letter explaining why.

    They were more than understanding and just said, "we will stop marketing your property, and if in the future circumstances change and you wish to sell, we will have everything on file".

    No mention was made of having to pay a penalty so I am keeping my fingers crossed on this issue.

    Sounds too easy!
    just a word of caution, check what your contract says about if you do sell your house in the future. E.g. if you sell it with another EA within a certain period the contract may entitle the EA to a cut.

    Sounds like they took a sensible approach. Why charge £150 when there's potentially 10x that up for grabs down the line by keeping client happy

    I wouldn't be surprised if they only invoked the £150 charge if you went with another estate agent before your contract would have been up.

    White Noise, I certainly won't be selling this year for sure, and of course if I went with another agent within the next few months it is reasonable to assume they would want their commission.

    If I put it on the market again, I would certainly go with them as they do seem very fair.
