As I said if you are paid for working 24 hours a week then you are probably fine. That is what complicates your situation, because your pay is not in line with the real hours you are working.

persons working flexi hours may not work the hours they are being paid for but would be working more hours that they are paid for at other times to make up the hours, just as the OP is doing.0 -
The week I work 27 is variable I could be given like days notice they could say I'm needed next week they pay me on my average hours easier for them and me as iv already said I suffer with anxiety it may sound silly but I don't cope well with change been paid different each week makes me so uncomfortable if much prefer to have same pay every week.im totally confused if tax credits can't give me a proper answer who can I ask iv rang 3 times now first 2 said I'm fine averageing my hours then I ring again today at first the woman says it's fine they she says oh no u can only do that if you work 25-30 hours but because I'm paid at 24 I should be fine what does she mean should be it was like she didn't have a clue I can't keep ringing til I speak to someone who tells me a proper answer I'm waiting up to 50 min each time I ring it's costing me loads0

Because they won't let me I have begged threatened to leave everything they will only give it me variable over the month that's it they say they don't need me for an hour a week0

You've a contract that stipulates 24 hrs p/w and if you're paid for 24 hours....

I already am making my self ill tax credits are telling me different things every time I ring them the one I spoke to today couldnt even give me a proper answer it actually didn't make sense what she even said.i don't want to be doing something that is wrong and could get me in trouble that's why I'm trying to see if it's right or wrong what I'm doing I don't want to end up getting a compliance check and end up oweing lots of money or worse be committed of fraud or something0

You aren't going to get a proper answer, you are going to keep getting different answers because the law is written in such a way as to make it like that.
Compliance only ask for two things from employed people - payslips and contract. Both of yours say 24 hours. You will be fine.
If by some weird chance they found out you were doing 23 x 3 and 1 x 27 week then you can tell them you checked and the helpline said it was ok (which they did twice).
Worse case scenario is they don't accept it and raise an overpayment. You will not be prosecuted for fraud. And i would say it is highly unlikely this would happen because of the above.
There is no more reassurance anyone can give so you either run with it or you don't.

Ok thank you at least I have noted the useless woman's name down from today if I have times and dates from all calls I make to them is that used as prove that I have asked does there system allow them to see I did ring on the dates and times I give them0

Yes and you can ask for recordings of the calls, although occasionally they are not available.

Thanks I have been to see my local CAB today for advice n their advice was that my pattern is a regular pattern so can be averaged over a month every month to give 24 the lady told me there is cases where some people work two weeks on n two weeks off and their average is taken over a month0
