    Like with Income Support or Jobseeker's Allowance, if a recognised ‘pattern’ of work can be shown over a period, then it is possible to average hours of work over that period, otherwise hours can be averaged over a full year.

    Give the total number of hours you usually work and are paid for in a week for all jobs that you do. If you normally work overtime, include this.

    If your hours vary from week to week, put down what you and your employer(s) think of as your normal number of paid hours.

    Which is what I said. It is about your normal working hours.

    I don't agree fully with the Turn 2 Us one.

    As I also said, the law is open to interpretation by everyone, including HMRC.

  • I'm going to ring again tomorrow and get the name of the advisor and again log the call and time then that's 3 times I would have rang their exact words when I rang before were that because there system doesn't allow for 1 week of change they take an average over a cycle eg in my case they said would be a month I stipulated to them that for 3 weeks of the month I will be under the threshold at 23 hours and they said that is still fine.i know I am paid at 24 hours but I'm worried if I was ever compliance checked at least I can have evidence that I rang and asked about the averageing over 4 weeks regardless of how I'm paid weekly
  • So does it sound right that they have told me it's fine to do it over a regular 4 week cycle
  • If I add my hours together of 23,23,23,27 divide that by 4 weeks I get 24
  • I have spoken to tax credits again and told them that iv had other advice about what they told me previously may be wrong well anyway the woman tells me that I was told wrong advice last time it is a minimum of working 24 hours you can average it out if you work 25-30 but not if you work under 24 after nearly having a panic attack I explain that as my weeks are variable as to what week I work the 27 on my employer pays me at 24 weekly anyway then she says well that's fine I can claim as working 24 hours cus that's what my employer pays me at.i took her name and wrote down the time I rang and day does this sound right cus she didn't sound like she knew what she was on about

    I have told you all I can on this subject. There is no clear answer. I have no idea what she is referring to about averaging if you are over 24.

    As I said if you are paid for working 24 hours a week then you are probably fine. That is what complicates your situation, because your pay is not in line with the real hours you are working.
