asda smart parking ticket

Hi new here i got a parking fine in asda back in January.the company on the ticket was 'smart parking'. i had paid for the parking but my ticket blew down when i shut my door. i showed the guy who gave me the fine and he said there was nothing he could do. As i was walking away someone came over and told me i didn't have to pay. He said he'd had two already and hadn't paid. i did some digging on here and everyone is saying the same thing. 'DON'T PAY'. i got a letter back in march saying i needed to pay the amount shown or they'd hand it over to a debt recovery service, again as advised on this site i ignored the letter. today i received a letter from the debt recovery service 'debt recovery plus ltd' i just wanted sone advice as to what i should do.

hopefully somebody can help me out.

    assuming you are in england or wales "this site" has not advocated ignoring these parking INVOICES (not FINES) for over 2.5 YEARS, since POFA 2012 came in , so am afraid you are totally wrong there (I have been advising the same for almost 2 years)

    this should have been challenged with the appeal letter from the NEWBIES sticky thread at the top of this forum

    I suggest you send the template letter to SMART, although you will be lucky to get a popla code now as they can and will say you are "too late"

    in future , APPEAL , asap (read the NEWBIES sticky thread for the details)

    IGNORE drp, they are powerless

    you can ask ASDA to cancel the ticket (as landowner), that would be the best option now

    ah it would seem i have messed up big time. i will send the template and see what happens from there. i guess i may end up having to pay the £120 they're asking for

    I see your point but if i don't have to pay them then whats wrong with just ignoring them?

    if it went before a judge they wouold expect you to at least try to have sorted it out, so you create a paper trail

    there is no need to pay them , not unless a judge ordered it

    send the template letter to smart

    ignore DRP (only a fool would pay them)

    complain to asda

    not that hard really ;)

    Thankyou for your reply it helps a lot. So do you think it could go before a judge then?

    it will if the PPC or the landowner (or managing agent) issued an MCOL against you (which up to now is not a Smart Parking feature)

    there is a paper trail in this MCOL business and it can be allowed to go to mediation, possibly to popla if its a BPA member, but let us assume its stalemate between the PPC and you, then it will go before a judge to settle the matter (that is the point of an MCOL , its a small claims court over which a judge presides)

    I cannot predict the future (neither can you) so it doesnt matter what I think

    what matters is knowing the processes involved at all stages, I am outlining possible outcomes (not what I think)

    ie:- nothing for 6 years (unlikely)

    debt collector letters for 6 years (very likely)

    an LBC (unknown)

    an MCOL (unknown)

    hIghly unlikly to to go to court, as its not smarts current business model. however they have 6 years to change look at parking eye for example. a lot can change in 6 years.

    Have your complained to asda yet? if not then stop wittering and do so.

  • hi can someone point me in the direction of the template 1st appeal letter ive got the same problem with smart parking in asda newquay but onl just received the pcn
