  • just to add I have just noticed on google earth, one sign on the actual property she visited saying parking for customers only, and literally directly above it one of the blue NGP enforcement signs saying no parking at all, very ambiguous and confusing, hope this can help in my case too at some point???

    depends how old the google earth picture is, so it really depends if its the same now as when google took that photo (the one of my house is several years old)

    if this is the case, then its extra evidence for a popla appeal

    Yes it is, been to site today to take a high res photo of ngp sign to read the small print, and it's still the same today.

    also unsure if it matters, but if you look, the sign above our car is worded differently to that one as well..

  • OK, template letter done and sat in the envelope waiting to go down the PO tomorrow!
    Thanks again to everyone who took the time to reply and help me..

    obviously these letters are designed to unnerve and intimidate you into paying, and it almost did just that, only you guys have given me the confidence to fight it and decide I am not paying them, ever, unless it does go to court of course!

    I'll keep you updated..

    Make sure you get a free certificate of posting from the PO. So many forget to do this, then regret it later.

    Do not send 'Signed For' (aka Recorded Delivery).

  • Just a note following on from early discussion on page 1, I emailed the lease company today complaining about them forwarding on the NTK and not returning it to issuer, they have replied that they do this for 'official fines and penalties', but because it is a private company and not an official body etc, they are unable to pass on my details to them due to data protection laws!
    Sounds fair enough??

    Anyway, the template letter is away, time to sit back and start drafting up my POPLA letter!!

    Didn't want to get into an argument with them at this point, they have accepted that I am disputing it, but added on the end to keep them updated as the outcome.
    Am I under any obligation to do this as they are the registered keeper? Assuming worse case the template and then popla fails and I then go down the just not paying route, do I tell them I failed my dispute but am still not paying??

    With regards to starting my popla letter, just wondering do I go down the route of...

    A) accepting the car was parked there, but dispute charge with misleading/ambiguous/contradictory signage as per the photos above?

    or

    B) as the NTK does not specify a 'period' of parking only states a fixed time of 1423, and this does not constitute proof of parking, do I say the car was left temporarily while the driver asked as the premises if it was ok to park there or not, was told no, and then left within one minute, and during this minute the NGP op was parked up waiting to ambush, ran out took the photo and vanished again, not giving fair grace period for the driver to decide not to park??

    accept nothing , question everything , use multiple arguments, including but not limited to

    not a gpeol, poor signage , no contract , flawed NTK , etc

    the more the merrier

    also bear in mind that hire companies inform these parking companies of the KEEPER details on a daily basis , so clearly there is a distinction between the DPA and absolving yourself under POFA 2012

    also, many RK also name the driver where necessary , even if its Motability or some other institution, never mind those pesky Hire companies ;)
