Neighbours Wall Wrote Off My Car

If the insurance company write that off they are having a laugh! I would imagine those repairs would easily cost less than £300 if someone was doing it for mates rates.
You really made a mistake not letting them do the work. Its just minor denting! How could that possibly do any real mechanical damage?
If you really think your car is that worthless I would have just left it and carried on driving it complete with dents.0 -

its not £300 worth of damage - the whole drivers side is damaged, this is just a few pics of whats happened. bumps on front wing, both doors, back panel, back bumper and bottom seal.
There is no way I would drive that car like that! its a mess, yes it may seem worthless to you but that car meant more than money to me, it meant I could get me and my children out, to their clubs, day trips, shopping etc, I cant do public transport, my youngest has autism and situations like that make her anxious!
I had that car resprayed last year because the original paintwork was chipping and spent a lot keeping it in good condition!0 -
As said, this would easily exceed 350. If they was willing to fix it before they would have happily paid the excess. Plus it was the son that said it not the owners. You did the right thing.
I'd speak to them again, say when are they reimbursing you 350. If they refuse tell them if you haven't got it by the end of the week your taking legal action. If still nothing send them a letter before action giving them 14days, the hope is you can scare them in to paying. If still nothing you should really go for a free consultation with a solicitor.
your insurers will charge you for the whole year, but they should let you continue with the policy on a new car for the rest of it.
you have my sympathy though as the excess and policy will wipe out a sizable amount of the payment.
hopefully they will pay for a repair rather than write it off.0 -

its being written off, the repairs by their approved garage would have cost £3598 to sort out. Mainly because of the back panel and bottom seal damage. If it weren't for that it probably would have been economically repairable. yes before anyone says, it may be cheaper to sort out elsewhere but you still looking at, at least £1800 because the whole side needs repainting and its a specialist paint because I changed it when the previous colour was chipping.
Ive been offered £1400 for it from the insurance, which in all fairness is a pretty good price for the car so ive had to take it I was expecting less than that, but ill only get £1050 because of the excess. I don't think im being unreasonable in asking for the excess off them. A solicitor has said I can claim for excess, loss of no claims and the higher premium charges but only feel that I should ask for the excess as that's what ive lost at this point. The no claims loss and excess premium wont come into effect until next year.0 -
Am expecting a knock on the door today from them as I sent a letter yesterday asking for their building insurance report for the damage to see what they think caused the wall falling over. Also trying to find weather reports for that night aswell to see what the wind was recorded at. Tbh ive inspected the other part of the wall they did replace, and all that is cracking and not in a good state so obviously in my own opinion, the wall probably was weakened and the weather just helped it topple so it really could have happened at any time, and being that kids walk past their wall on a daily basis because they are right next door to the school they need to have it inspected for their safety aswell.0

Have got information about the wind speed and gusts during that night. It was no way strong enough to be classed as a storm so shouldn't have knocked over a wall if it was in good condition.
Sorry you are entitled to your opinions but I cant let this go, ive lost my independence and all the stress its caused too. but thank you all for your help. Im now going to build my case and make it watertight.0 -
Looking at the picture posted of the wall, I think they have allowed the tree's and shrubs to effectively push the wall over and could be deemed negligent.
I would think you are in a fighting chance of claiming from the insurance company for losses.0 -

Absolutely, this was taken by google street maps in 2008 and was only cut back last year, it had been overgrowing for years, there was also ivy all over the walls too previously which is why they had the rest of the walls pinned because it was pushing them over0
