Just because that statement isn't contained within the T&C's section of the website doesn't mean that it doesn't form part of a contract.
Both Trading Standards and the OFT have repeatedly stated that anything written or voiced in an advert must be factually correct, something that is clearly backed up by the Unfair terms in contracts legislation.5.—(1) A commercial practice is a misleading action if it satisfies the conditions in either paragraph (2) or paragraph (3).
(2) A commercial practice satisfies the conditions of this paragraph—
(a)if it contains false information and is therefore untruthful in relation to any of the matters in paragraph (4) or if it or its overall presentation in any way deceives or is likely to deceive the average consumer in relation to any of the matters in that paragraph, even if the information is factually correct; and.
(b)it causes or is likely to cause the average consumer to take a transactional decision he would not have taken otherwise

If they are unwilling or unable to physically provide the service that they have stated that they will provide then they shouldn't offer this in the first place or at the very least they should have a disclaimer stating that their promises are not guaranteed.

Complain to ASA also.
IMHO ASA are the ones to complain to if you really want to cause the website maximum annoyance.Unless specifically stated all posts by me are my own considered opinion.

Elite have admitted that they don't have enough matching profiles to send me the minimum number each day .
They then went on to offer me a month's free membership by way of compensation . So , to compensate me for their poor service , they want to give me more poor service !!!
How ludicrous is that ? Does it in any way make up for all the time and money I have wasted on their website?
The only decent thing they can do now is to refund my subscription , right ?0 -

Haha but the problem is that there are no terms and conditions relating to this! Also, there is no mention of time frame and so it is you assuming that their blurb relates to the entire duration of the contract! Finally, it is unreasonable to expect yourself to be compatible with 3-7 women DAILY for a long period of time, especially when you consider that their alexis ranking (low confidence) suggests that the majority of users are men.
Above all, I just can't understand why you are paying for this service in the first place and why it bothers you so much! Is it so hard to log on and message a woman you kinda like the look of, instead of waiting for this third party (who ultimately only want your money) to tell you who to message? Nothing against dating sites per se, but just don't understand why your expectations are like this on this occasion! The only criticism I have for elitesingles is that they haven't created a load of fake female profiles which they can send you should they run out of the 3-7/day legit ones, that would keep you lining their pockets:
Firstly , I'm a woman , so if the majority of users ARE men , there should be more than enough profiles to match me with .
Secondly , waiting for Elite Singles to send me profiles is the only access I have to their data base . There is no freedom to browse other profiles : members are not allowed to make their own free selections . So I don't know how you expect me to just 'log on and message someone I like the look of'. I can't do that . Unless Elite Singles send me profiles , I have nothing and it bothers me so much because I have paid nearly £90 for a service I am not receiving .
Or perhaps you were meaning that I should log on to a different website , if so , which one ?0 -
I would be looking at how many they have sent you, and working that out as a percentage of what they should have sent you, then asking for a refund based on that ratio.Should've = Should HAVE (not 'of')
