My friend has a allocated car parking with ten other in the common area. Now the neighbor who's compound garden wall is close to the car park complain over the tree which came to his wall and doing damage from divider(1 meter width and 1 meter height fro about 30 meter length of one side) between the car parks and his wall. Noone uses the divider, not sure who is owning it.

who is responsible in this case to sort out tree and his damage, can it be park holder who is nearest to the neighbor compound wall/divider belong to noone/all car parking owners. Who is responsible for the tree to be cut. The land registry is not clear enough to decide this.

    Do the flats have a management company ? if so they would be my first port of call

    It's not clear where the tree is, is it in the car park or is it on the neighbour's land?

    Anyone else disappointed by the mundane nature of this thread, having spotted the title and opened it?

    From what I can gather, it seems there is a parking area for flats, or whatever, with 10 designated parking bays. Between the parking area and a neighbouring property is a small strip of land with a tree. which is overhanging the property's wall and possibly damaging it. The property owner isn't pleased.

    The OP wants to know who is responsible for the upkeep of the tree and claims Land Registry documentation isn't clear on this.

    Yep, I too was expecting something a bit different - and wondering why it would be on an MSE house buying forum - value affected by ghosts? Cursed?

    But it's a bit mean to expect someone who is clearly writing in what to him/her is a foreign language to understand the difference between a hanging tree and an overhanging one ...

    It is really hard to see, once we cut the trees then we should be able to tell. But it looks it is likely to be inside the car park. However, I suspect it could be from neighbor garden as wall or it would have started from his garden initially. In the car park there is no sand/soil and it is fully covered tarmac.
