Yes. Unless Car 54 wants to argue that people marginally exceeding the speed limit should receive the same sentence as a murderer, his/her argument falls flat on it's face.0 -

That is an utterly absurd comment.
The magnitude of the crime and the severity of the possible sentence may differ, but the rules of evidence are the same.0 -

In the terms of where the police are parked witnessing a murder is unlikely to have the evidence excluded. However unlawful acts can cause evidence to be excluded.0 -
78Exclusion of unfair evidence.
(1)In any proceedings the court may refuse to allow evidence on which the prosecution proposes to rely to be given if it appears to the court that, having regard to all the circumstances, including the circumstances in which the evidence was obtained, the admission of the evidence would have such an adverse effect on the fairness of the proceedings that the court ought not to admit it.
(2)Nothing in this section shall prejudice any rule of law requiring a court to exclude evidence.

As mentioned previously most scamera vans are not crown vehicles and therefore have to be parked legally to operate , if they are on a grass verge they need written permission from the local council to close off that space and operate . But the better point is that with mobile units a police officer MUST be present to witness the offence , fixed cameras like gatsos operate under specially made legislation so are exempt from this. Ask yourself why? This is to stop people like me and you buying an old van, fitting a camera and dishing out speeding tickets to whoever speeds, always ask for the number of the police officer who was present and witnessed the offence and the reply is usually "we dont give out personal details under the data protection act" , reply with the question "I'm asking for his number and name which I am entitled to as I am being accused of an offence" , that is usually the end of the matter, police officers can issue speeding tickets, muppets employed by the local council sitting in a "partnership van are not police officers and have the same powers in law as you and I do, they are praying on people's ignorance of the law0

That's an entertaining view, but sadly wrong in so many ways.0

Yeah but it's a great story by the drunk in the Dog and Duck, love bar room lawyers, really entertaining, and great fun to listen too when they represent themselves in court, don't let the law get in the way of a good rant :rotfl:0 -
