Parking eye CCJ

Help again!

I am in the process of applying for a mortgage and to my horror I have a CCJ which I now know is because of Parking Eye.
Does anyone know how I can get rid of this quickly?
Any help would be much appreciated as I am not planning on paying a single penny to these fraudsters!

    Have you moved recently?

You can apply to have it set aside, but you'd have to have a reason, ie they sent notices to the wrong address. If you just ignored the county court summons you'll have a hard time.

I do not know how to get rid of this quickly, but I would not come on a money saving board to enquire. I would say that trying to save money if you urgently need a mortgage is not the way to go about things.

Seek professional advice, a solicitor, credit cleaning company, (beware of the rip off merchants who infest these waters), mortgage brokers, etc.

Be prepared to shell out a few hundred pounds, if the CCJ was issued by a PPC without following due process and/or you get the original decision overturned, you will eventually get it back. l
You never know how far you can go until you go too far.

Check out Parking Prankster's blog and website. He has info specifically about Parking Eye court procedures, and also regarding set asides.

Yep Google 'Parking Prankster how to set aside a ParkingEye CCJ'. We can't add more to that expert Blog.

Paying ParkingEye WILL NOT remove the CCJ by the way, as it will merely stay there marked 'satisfied' which still shows up. I would pay £155 as explained by the PP Blog, and get it set aside if you have several weeks to play with...you may not?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I relocated but in between updating the DVLA on my address for the car registration, the parking charge had been issued by parking eye for overstaying a 2 hour period at Solihull Morrisons.
This has now cost me a preferential mortgage deal which would have saved me almost £3000 over 2 years and it is now putting in jeopardy another application.
The only reason I said about not wanting to pay them a penny is because I understand how a lot of you on here are dead against these companies unlawfully charging people.

Also what I don't understand is why courts are making judgements on these charges if these charges are unlawful? These judgements are affecting peoples lives!

Because if the defendant fails to acknowledge the claim, or doesn't enter a defence, or doesn't show up for the court hearing, the Court won't consider the lawfulness or otherwise of the claim, they will simply award Judgment to the Claimant by default.

That's why you should always update your DVLA details straight away when you move house, otherwise you may not know about stuff like this coming to bite you on the bum.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Start by filing a N244 form, use the explanation "papers served to wrong address resulting in CCJ + case default judgement incorrect in law

Applied for the set aside and I now have a date to attend court. What to expect, how can I prepare for this?
