SKY monthly fee increase - promised not to!!

Options
Hi,

I cancelled my Sky subscription a year ago, I was thinking of going to Virgin.

In the last few days of contract, I received a call from Sky, who asked me why I was leaving. I told them I was cheesed off with the increases to subscription.

They offered me a good deal, and promised it would not rise for 5 years. So i took it.

Since then, I've noticed a few increases so I called them last week to complain.

They told me it was agreed I would have a % discount for 5 years, not a fixed subscription - this is not what I remember.

I asked for them to listen to the recording, they said yes, no problem, and to call back today for the outcome.

Called back earlier, they have not listened to the tape. They now tell me irrespective of what was said @ start of contract, that because they send letters informing of subscription increase, the agreement is now void. Even though I don't recall any such letters.

Surely a verbal contract is a contract - full stop. And now, they want me to pay £10 for a copy of the recording.

Am I wasting my time getting a copy of the recording, or are they right, even if I do remember correctly?

Sorry for such a long post, but I thought I should get all info down,

mikrt.

No one from Sky would be able to guarantee a 5 year fixed price-they are never fixed price contracts.
They are always discounted off the rack rate, so if that rises, so does the price you pay.

But if the person who the OP dealt with stated it wouldn't rise for 5 years the fact that they didn't have the authority to do that isn't the OP's problem.

It's not outside the realms of possibility that the advisor told a little lie to get the OP's custom now is it. Given some of the bull I've heard from both Sky and VM I'm more than willing to give the OP the benefit of the doubt.

OP if you're sure you're right pay the £10 and get a copy of the conversation.

If the advisor did indeed day no price rises for 5 years then you're perfectly entitled to expect them to fulfil that promise as you took the contract based upon it.

    Thanks all for replies,

I'm 99.99% sure I remember the price being fixed, not a % discount. The % discount mentioned last week was the first I'd heard of it.

I'm waiting for a pack to arrive by post before I can go any further.

What would be my next course of action, when I have paid my £10 for a copy, and it does state a fixed price. Sky said yesterday that contract has been superceded by letters (which I never got). Is there an ombudsman or similar?
  • Did this offer come with a re-contract period? If so and you are close to nearing it then it's probably not worth paying for the recording, as it is a long winded process, think it can take up to 8 weeks for copies of recordings

    Thanks GA,

Re-contract period, is that minimum term for contract? That's 12 months - 3 months away.

Long winded, you can say that again. They told me about 40 days.

The thing is, if I do re-contract, I wont get a deal anywhere near as good as I was promised last year (which was meant to be fixed for 5 years)

    Yeah, the minimum term

I've never heard of fixed price deals, so clearly the advisor messed up (knowingly or unknowingly) and Sky could probably argue (as they are) that the correspondence would have contained the information. Also it would be tough for them to honour a fixed price for 5 years as who knows what price increases will occur and when

I think you are best working out what the difference is between the price you was told and the price with the increase (can't be more than a couple of quid I guess) and decide if it's worth continuing with Sky

What is the percentage discount that you believe you were offered?

I think he got the 33% off deal (my brother got this) but the advisor didn't present it as that, rather he seems to have said with this offer it will cost you X amount for 5 years, not taking into account the impact of price increases

They told me last week that it was 35%. It's gone up by nearly £4 a month since I started, and it's going to keep on going that way. Still nothing in the post though like they promised there would be.
